Why was the case filed at the International Court of Justice?

Humanity's longing for justice and security is immense. People can only live in peace and happiness when they have justice and security. Israel's monstrous genocide has darkened the hope for justice and security for all of humanity.

People have come to better understand what a human is through the Israeli genocide. In truth, if the human species has not truly been educated in humanization, it produces great monsters.

The states of global capitalism, the USA, the EU, AND ISRAEL, have set humanity on a path of becoming monstrous. Humanity is becoming increasingly monstrous.

Hitler's genocide, the atomic bombs the US dropped on Japan, and most recently the Israeli genocide clearly show that humanity is taking giant steps toward becoming monstrous. In the face of this monstrosity, a rotten civilization says, 'let the snake that doesn't bite me live for a thousand years.'

The Israeli genocide has revealed another very important truth. The civilization humanity has reached is a fake civilization. As technology advances, so does monstrosity. Crime rates are also increasing.

Governments are unable to manage states according to the interests of their peoples. Class interests come first, personal interests come first. Today, the working class is like the slaves of the Middle Ages. The phenomenon of migration that humanity experiences with pain, poverty, lack of ownership, and lack of organization—all these keep humanity living in pain.

A new civilization is needed. A civilization like South Africa's sensitivity. Not the West's fake civilization, but the real civilization that humanity needs.

Unlike the International Criminal Court, the International Court of Justice, which is the UN's highest judicial body, handles disputes between states rather than individual crimes. For this reason, the case was filed at the International Court of Justice.

What does the Court of Justice's decision on Israel mean?

ANSWER:

The International Court of Justice issued a provisional measures order against Israel with a 15-to-2 vote. It ruled that Israel should be tried for the crime of "genocide." So, how will the process continue? What does the decision mean?

c-It was decided that Israel must take all measures to prevent the commission of the crime of genocide.

So, what does a provisional measures order mean?

"It has been revealed that the rules regarding the right to defense have been violated.

The fact that the International Court of Justice has expressed the opinion that there is sufficient evidence to hear the case is in itself a significant situation.

It sets forth a judgment that the moderation and proportionality regarding the right to defense have been clearly violated.

The court has determined that there is an urgent situation. It has requested that the occurrence of irreparable consequences be prevented. It has determined that the Convention on the Prevention of Genocide has been violated. It has ruled that the destruction in Gaza and the infrastructure have been devastated. It has emphasized that Israel is massacring civilians.”

The Security Council makes political decisions. The Court of Justice makes judicial decisions. These two institutions may have to make decisions on the same subject. In this case, there may be an overlap between the decisions, or there may be a conflict. While there is no problem in the case of an overlap, what will happen in international law in the case of a conflict is a matter of debate.

What is expected to be in the report?

ANSWER:

The court requested a report from Israel within one month. The things that should be in this report are as follows: (Orallı)

a-Whether Israel is complying with the provisional measures order.

b-Whether it has retreated to the principles of proportionality and moderation.

c-The assessment of the damage that has been caused.

d-Providing evidence for future cases.

When these determinations are made, Israel should not cause further civilian casualties as of now. It should be able to serve as evidence in the event that it has to pay war reparations or legal compensation one step later due to the existing damage. It should facilitate the burden of proof.

“This decision taken by the Court of Justice, most importantly, emphasizes that the crime of genocide is being committed. It has paved the way for Israel to pay strong compensation to Palestine, and although the word 'ceasefire' is not mentioned, it carries the importance of a call for a ceasefire due to the mandatory nature of complying with the provisional measures.”

All states and peoples must focus on Israel's report. Are the necessary items in the report? Otherwise, everything can be ignored through various methods of fraud and immorality.
