1) The Crime of Allowing Use of a Bank Account:
In our articles dated 18.10.2025 (https://12punto.com.tr/yazarlar/cenk-ozdag/yeni-yargi-paketi-magduru-gordu-insani-gormedi-101021) and 5.07.2025 (https://12punto.com.tr/yazarlar/cenk-ozdag/banka-hesabini-kullandirmakiralama-sucu-92323), we wrote about the regulations concerning the crime of allowing the use of a bank account. What we wrote has come true, and continues to do so. As you know, when it comes to crimes of qualified fraud, those who rented out and/or allowed the use of their accounts were previously escaping these qualified fraud accusations due to a lack of the subjective element (intent) of the crime. A regulation was subsequently introduced; thus, the path was cleared to punish these individuals without violating the principle of legality in crimes and punishments.
However, in current cases, while these individuals should have been tried according to the old regulation, they have begun to be convicted through the expansion of judges' 'discretionary power.' Yet, 'discretionary power' cannot be expanded to this extent. If there was no legal rule at the time of the act subject to the crime that brought the action within the scope of crime and punishment, these individuals should not be convicted. Thus, we have crossed another threshold in the state's fight against crime. The principle of legality in crimes and punishments can now be violated.
2) Abolition of the Diploma Requirement:
At the beginning of the debates regarding the cancellation of Ekrem İmamoğlu's diploma and the prevention of his presidential candidacy (1.03.2025), before any cancellation had occurred, we wrote another article:
https://12punto.com.tr/yazarlar/cenk-ozdag/diploma-meselesinde-radikal-cozum-75569
Our argument was clear: The requirement for a diploma for the president was a necessity of the old regime. The aim was for a person who had received higher education to look at issues from a more distant and qualified perspective, and to be able to maintain the necessary impartiality as a representative of the entire nation. Of course, there was also the desire of the May 27 coup supporters to prevent Celal Bayar from becoming president. After all, Celal Bayar was not a university graduate. However, today, the office of the presidency can be partisan; today, having received higher education does not lead to major changes in a person. As a result of both the decline in the quality of higher education and the 'democratization' of information sources through online applications and procedures, this diploma no longer carries any weight. Therefore, seeking criteria such as a diploma, age, and the like in a presidential candidate has become meaningless.
Someone must have heard us, as there are rumors that these criteria will also change. I hope it will be a beneficial change.
3) Abolition of compulsory education:
On December 28, 2024, we wrote about a hypothetical approach to terminating the right to education: https://12punto.com.tr/yazarlar/cenk-ozdag/sozlesmenin-feshi-zorunlu-egitim-66357
I repeat: 'Modernity as we know it is ending. Despite all this change, we are still trying to find remedies through old institutions. Regardless of which view you adopt, the Ministry of National Education's education model has collapsed. Days are near when we will no longer be able to ignore this reality!'
The collapse is coming even faster than we expected. Examples where immorality has peaked, grave incidents where our children's safety is violated, instances of ignorance that go beyond the dimension of a joke... On the other hand, there are alternative education models whose opportunities are expanding with online applications and methods.
4) Making divorce easier:
We have written about this several times. The procedure for rulings in divorce cases must change. In contested divorce cases, where the intent of both parties to divorce is clearly stated, the court should rule for the divorce of the parties without waiting to determine the degree of fault and, consequently, the decision on compensation. Thus, especially the woman's right to build a new life, to continue her life by having children with someone else if she wishes, and in general, the rights of the parties to emerge from this exhausting process with minimal damage must be protected. We had written these. Now a new regulation is on the way. If the legislator is determined and the Constitutional Court does not annul it, couples will now be able to divorce more easily. The obligation to live for many years with lies, hypocrisy, and unrest will be eliminated.
5) Clean hands operation:
We wrote on 27.12.2024: https://12punto.com.tr/yazarlar/cenk-ozdag/ahlaksizlik-ve-siyasetsizlik-106794
I said the following: ''Strange things are happening in Turkey right now. Getting positive results from the reports of international financial rating agencies, changing the agenda, cleaning up the area, eliminating alternatives... Even if these are true, regardless of the reasons, we are witnessing a series of events that resemble ''clean hands'' operations. We realize that the salt has gone bad. First, the Newborn gang and similar criminal organizations, the immorality occurring within the police, the judiciary, municipalities, the media, and the sports world, the drug trafficking... All of these are examples of immorality springing up from the corners of society... It seems someone has pressed the button in our country. Perhaps it is not a hidden hand, but it is as if those who want to do their jobs properly are not being hindered, and it is as if these people are being encouraged with a ''go ahead'' signal.''
Drugs, debt, the inability to use one's mental faculties, blackmail, and prostitution cases... All of these point to social decay, moral degradation, and the instrumentalization of this decay and degradation in the economy and politics. Immorality is not political on its own. Therefore, it usually does not generate a political response or reaction. But if immorality becomes politicized, if it gains political representation or a front, that is when the moral problem becomes politicized; immorality itself becomes the material for resolving political conflicts. That is what is happening now. It feels as if there is more to it than what we have always known and witnessed.''
Indeed, what is happening? Drug operations, the Ayhan Bora Kaplan cases, operations against municipalities, extortion cases, Gülistan Doku, and many more...
What do you think? Is there someone reading us?
