Minister of Justice Tunç has made a statement regarding the 9th Judicial Package: "We are striving to do whatever is necessary to protect society from crime. The crime of insult on social media is increasing. Serious deterrent penalties are coming for insults. We are doing whatever is necessary to protect society from crime. We have serious efforts underway regarding the perception of impunity." (Hürriyet, November 15, 2024)
So, there is a "perception of impunity." The public perceives that those who commit crimes do not receive punishment.
So, the "crime of insult on social media" has been increasing.
So, it is necessary to "protect society from crime."
How will society be protected from crime? Are we going to protect society from the actions of criminals? Are we going to protect society from committing crimes? Or both? What is the reason for what drives society toward crime and why criminals threaten society?
While all kinds of harsh expressions are used on social media against Atatürk, Alevis, leftists, and Kurds, criminal complaints against them yield no results. Decisions of non-prosecution are issued.
The slightest criticism directed at the President and the government is immediately investigated with a simple CİMER application.
Let's be honest. Our concern is not fighting crime, keeping society away from crime, or protecting society from crime. The number of crimes has increased significantly. There is no possibility of punishing them all. There is not enough personnel to examine the actions of so many people, to try them in the judiciary, or to investigate them. If they are found guilty, there are not enough prisons. Either the laws will be relaxed and some acts will no longer be considered crimes, or criminal proceedings will be postponed/prevented/not carried out... In the current understanding of politics and state administration, no other option is visible.
Let's be honest. A double standard is being applied. The belief of dissidents in justice, the state, and the judiciary has been shaken. Open campaigns of insult are being carried out against Atatürk, Alevis, leftists, and Kurds. Applications against this yield no results.
Even though I defend unlimited freedom of expression, when a double standard is applied, I can understand those who are disturbed by the insults directed at them that are practically favored.
Let's be honest. Crime policy and penal policy cannot be fixed with a judicial package or similar things. Crime policy does not fit within the scope of duty and authority of the Ministry of Justice. Without addressing education, justice, tax, and cultural policies together, one cannot fight crime and criminals; social peace and tranquility cannot be achieved. But that is not the concern. The concern is: more money entering the state treasury, managing the situation despite the lack of personnel, shaping perceptions, etc.
Let's accept it now... Society is fragmenting. Social bonds are being shaken. All social relations have been reduced to money, interest, and power. Those who have money and those who hold power and can defend their interests do as they please. Those who do not have these means are hunted like partridges and become victims.
Justice is the foundation of the state! If it is unjust, it is the cause of chaos! Let's be sincere. Those who feed on chaos are more powerful.
