Spirituality died long ago!

Did something happen to you? In a modern country, the place you should turn to is the law. When you turn to the law, you seek and find your rights, right? Yes, of course.

In Turkey, seeking and finding your rights is not that easy. Let's say you meet the minimum requirements to apply to the judiciary. In other words, you have money, you can access a lawyer. You can read and understand the laws. You can explain your grievance. Let's say your lawyer understood all of this. Let's even assume your lawyer was able to explain your plight to the judiciary.

You bought a faulty product. You went home and set up the product you bought. The whole family is waiting with excitement. A countdown was even done to operate the product. However, the product does not work. You searched high and low, there is no solution. You need to take it to the store. You set off on the paths of application to the Consumer Arbitration Committee. You might get the money you spent back months later. But the money has become worthless. The gas was spent on the road. The family's enthusiasm has faded. Beyond material compensation, there has been moral damage. But 'what does the judiciary care about this?' Right? Do our judges care? Does the legislator care?

Let's say you followed traffic rules. You crossed at a pedestrian crossing. A car hit you at full speed and you died. Let's say it was ruled as manslaughter with conscious negligence. Maybe the person who killed you served a few months. The money your family received is a ridiculous amount, and the killer got away with it. God forbid, if your enemy knew these things, I don't want to think about your end.

Let's say you were subjected to an unfair administrative action. The only thing you will get is the cancellation of the administrative action. Nothing happens to the official who performed that administrative action, nor does the administration get burned. It's not a human being that it would feel pain. Well, will you be paid? Our law is very afraid: Heaven forbid the victim gets rich, heaven forbid they say 'I'm glad this misfortune happened to me.'

Let's say you were subjected to faulty medical treatment. So much so that you almost died. It is easy to calculate material compensation, but moral compensation cannot be calculated. When it cannot be calculated, for us, 'it's not even worth mentioning.' Someone says, 'Let's give them a month or two of salary so the poor person's spirituality is compensated.' Yet, the one who causes pain should feel pain. They should feel it so they learn, and the person who had the misfortune finds consolation in the bonus of this calamity. Our legal system does not want this either.

Our legal system is very foresighted. It sees that all of this will happen and is afraid of victims becoming rich. It is understood that our legal system knows very well that things will not flow correctly and accepts this situation.

Our legal system is at war with the victim, not the crime. It sometimes fights with the perpetrator of the crime as well. Especially if our elders benefit from it. However, it is almost as if it is pleased with the crime itself.

In our country, 'concrete' and 'material' damages are compensated. One day, I hope our system accepts that a person's state of mind also has a physical reflection. Otherwise, this moral compensation will give the nation cancer. Or our people will resort to completely extra-legal means. Especially with inflation where money turns into nothing, one does not feel like seeking rights.

It is no wonder that spirituality is collapsing. When one looks at the amounts of moral compensation, one understands that spirituality is not valued in this country. Yet, what a parent who buys a gift for their child expects from the Consumer Court in the face of their child's disappointment; what someone who lost a relative to traffic expects from the perpetrator; what someone who was cheated by their boss or someone who died in a health institution they entrusted their life to expects in terms of moral compensation is not too much at all. But the price of having a strong spirituality is heavy in this country. One must crush their spirituality here. In a society where spirituality has collapsed, what are honor, pride, and conscience worth anyway?
