The oath to draft a new constitution

This year, on November 10, we commemorated the 87th anniversary of Atatürk's passing with longing and frustration. If, even after the state he founded has surpassed its first century and so many years have passed since his death, he is still carried in hearts, commemorated, and respected, then let those who wish to commemorate him do so in their own way!

The beauties and the ugliness displayed are indicators of the fabric of those who perform them. Let those who are not ashamed display the quality of their fabric!

The "communicating vessels theory," a fundamental rule of sociology, is being experienced in every field. Without counting them all—in politics, media, academia, etc.—and excluding Atatürk's daughters, the volleyball and basketball players, we see that this sociological rule is working with increasing depth.

Speaking of sports, what is this betting issue? Honestly, it is hard to understand! Another sign of collapse is that middle-aged gangs are further darkening hopes that were already non-existent. I do not believe that gang activities, drug trafficking, or even things like betting can be carried out innocently without the knowledge of the center! This is not an accusation, but in cases where it is not strictly monitored, those who keep things loose are mentioned in the same breath as the primary criminals. I think, according to the saying "the fish rots from the head," as society collapses, sharper odors will emanate from the layers that will surface piece by piece.

I do not know if such collective measures can be prevented! I do not know, because just as the horizontal division of society through social identities, the vertical division through economic powers also accelerates social decay and collapse, making it difficult for a blunted and fractured social consciousness to perceive these formations in all their gravity.

This situation creates a kind of consciousness blindness and facilitates the work of those who wish to maneuver negatively over society. The justification is as follows: Look, things are not working, society is drifting, etc., therefore, the society needs to be put back on track with a brand-new constitution and restructuring. Such a skillful maneuver makes it quite easy to reflect the phenomenon of a new constitution as the preference of the people, but this path damages legal rules and ethics. Who cares about the law anyway! Is our legal system not one that was adopted from the West, is necessarily applied, and is rooted in Christian ethics? Can there be a religiously rooted explanation for acting ethically and its perception?

Let us assume that all these things said are not realistic and valid. Then a more dire picture emerges. Namely, although the political power that carried the system to the presidential system has put in a lot of effort in this process—let us give credit where credit is due! However, entering into these matters with the intention of taking an oath of compliance with the Constitution and then using this phase as a stage to draft a new constitution according to one's own preference, while it may be seen as clever, is contrary to reason, logic, and even the rule of law; furthermore, such behavior is a discourtesy to the public and a disrespect to their votes. However, while the Middle East is being torn apart like carded wool and eyes are wandering over Turkey, one cannot help but think: is a new attempt to draft a constitution being used to reach a goal through new partnerships by swallowing all previous oaths in one go?

Well, if this is the case, who is dominant in the Middle East that they can be so primary in making and fully implementing instantaneous decisions in Turkey without passing through any filters?

So much so that, let alone criticizing or preventing the rapidly developing political decisions and processes, there is great difficulty even in understanding them.

In that case, regarding peace negotiations, it seems there is no hesitation in Turkey entering a position of making an agreement with two equal states, rather than as if compensating for past mistakes. A society can naturally apologize for the mistakes it has made, and it can make the necessary arrangements with its own mind and within itself so that past mistakes are not repeated. These are matters of internal negotiation and internal decision-making. In other words, the necessary internal accounting must be done, mistakes must be weeded out, and a new arrangement and/or implementation must be made accordingly, but these cannot be a matter of external negotiation at the state level. If issues that should be a matter of internal negotiation at the state level are being made into a kind of external negotiation, it can be thought that advice is being taken from or guidance is being received from certain powerful directing centers.

Method is very important while walking towards a goal. If a new constitution is to be drafted, a political structure that has led the country to this state after governing it for more than twenty years—with its economy, social structure, and even by criminalizing the very word "peace" that they do not let fall from their lips these days—should be in the rearmost ranks, or even not be involved at all in the drafting of a new constitution. However, the political power is dragging the country towards the drafting of a new "willful constitution" by completing the few seats it lost through unusual concessions and maneuvers.

The method for drafting a brand-new constitution is clear and known. Moreover, this method is of a nature that would exclude all internal and external factors and influences that could arise regarding the envisioned new constitution. The main engine of the method is to form a Constituent Assembly through a public vote or through the appointment of members by institutions, and for it to dissolve itself after the new constitution is drafted. Although the constituent assembly and its members do not work in an absolute vacuum and are not immune to internal and especially external factors, the chance of them being more independent and closer to the public than the cadre that still holds the power of government is much higher. Your jurists, especially those close to the center, have a very important and compelling duty to society at this very critical stage of history. Neglect of this duty will cause legal professionals to be punished in the presence of history in the first degree.

I hope that all jurists tasked with protecting all rights and laws will not refrain from undertaking such a historic duty.
