Even a One-Person Company Has Articles of Association!..

Approximately 9 years ago, Erdoğan addressed businessmen in Balıkesir as follows:

“Wouldn't you want this country to be managed like a business? Do you know what my concern is? Turkey should be managed just like a joint-stock company. Otherwise, they shackle your wrists, and you try to walk if you can. This country cannot leap forward this way... The 'New Turkey' will come to life with a new constitution. With a new constitution, the presidential system must also be established in the country. For this, the target is 400 deputies. When you give 400 deputies…”

They transitioned to the presidential system, and to the “New Turkey” regime as well... But they could never make Turkey leap forward. Not only did they fail to make it leap, but they also practically hit rock bottom in almost every field... And they are still talking about a “new constitution”... I think we all know what this means by now; Rest in peace to the spirit of the Republic of Turkey founded by Atatürk!..

IF THERE IS NO CONSTITUTION, THEY DO NOT EXIST EITHER

There was another expression Erdoğan used frequently; he would say, “One should not pick the fruit before it ripens.”

They have certainly “picked” so much of the Republic of Turkey's fruit by selling it off, shutting it down, or discrediting it, haven't they?

Now, it is the Constitution's turn. They have failed to comply with many of its provisions; but this is the first time in our history that something like this has been seen.

I am talking about the war being waged over Hatay Deputy Can Atalay.

A high criminal court and the Court of Cassation have refused to comply with the Constitutional Court's ruling for the second time, despite the clear provision of the Constitution.

The 3rd Criminal Chamber of the Court of Cassation issued another terrifying ruling today. I said “3rd Criminal Chamber of the Court of Cassation”; but the 37-page ruling did not contain the names, registration numbers, or signatures of the judges!..

If we come to the main points of the ruling;

1- It has been declared that the Constitutional Court's second violation ruling has “no legal value.”

Whether you like it or not, complying with Constitutional Court rulings is a provision of the Constitution. If it is claimed that the Constitutional Court's ruling has no legal value despite this, it also means saying, “The Constitution has no legal value.” Now, wouldn't one say, “If there is no Constitution, then some of the offices and institutions listed here are also null and void.”?

2- Sir, the Constitutional Court's ruling has been characterized as “juristocratic behavior.” Along with this, a letter was written to the Grand National Assembly of Turkey (TBMM) calling for the stripping of Can Atalay's parliamentary status.

Isn't the attitude of telling the TBMM what to do, in itself, “juristocratic behavior”?

3- And, for some reason, they recalled what happened to Prime Minister Imran Khan in Pakistan in 2022, effectively warning the government that “the Constitutional Court is a threat to you too.”

Setting aside the fact that almost all members of the Constitutional Court were appointed by this government and that the Parliament has been rendered dysfunctional; I ask this:

Have you ever seen a member of the government brought to justice to this day?

And furthermore, I remind you: When Erdoğan was still the Mayor of Istanbul, when the then-Deputy Prime Minister Murat Karayalçın asked him to be held accountable, didn't he say, “I only answer to my Lord.”?

HOW IS A JOINT-STOCK COMPANY ESTABLISHED?

Returning to Erdoğan's desire to manage Turkey like a joint-stock company;

With the amendment made to the Turkish Commercial Code in 2012, the way was paved for limited and joint-stock companies to be established by a single person.

However, even a joint-stock company established by a single person must have articles of association, and must also obtain a 6-digit “NACE code” to allow its economic activities to be defined and compared according to world standards.

It appears that the Republic of Turkey is being placed even below a one-person joint-stock company, and the country's existential codes are being erased!..

As written in the final sentence of the preamble of the Constitution, which explains the codes of our unitary and national structure; since the duty to protect and defend the Constitution is “entrusted and delegated to the love of country and nation of the Turkish children who are in love with democracy,” we are the solution!..
