Striking development in the petition of the whistleblower who stirred up the Bora Kaplan case

A new scandal has been added to the Ayhan Bora Kaplan case, which was opened on charges of running an organized crime syndicate. The presiding judge exposed a defendant who had submitted a petition to become a whistleblower in the courtroom.

On the same day, a report was filed stating that Ayhan Bora Kaplan had threatened this defendant by saying, “I will kill your mother.”

Ultimately, the defendant who wrote that petition and was stated to have been threatened by Bora Kaplan reported that he had written the whistleblower petition to trap the police officers who had framed them, and that Kaplan had not threatened him.

Let us explain the petition scandal that has been unfolding day by day and in detail in the case being heard at the Ankara 32nd High Criminal Court since Monday.

On the first day of the hearing, the presiding judge said to Fethi Koyuncu, the second defendant in the case, “You sent a petition from prison and mentioned effective remorse and such.” Koyuncu replied, “There is no incident I am involved in. Even if there were, I wouldn't do it.” When the hearing resumed after the lunch break on the same day, the judge said the following:

“While I was away during the judicial recess, the court panel filed a report and put it in the safe. It doesn't need to be in the safe. I have referred it to be included in the file; anyone who wishes can see it.”

All of this was nothing more than the presiding judge himself exposing a defendant who had declared he would become a whistleblower in front of the alleged gang leader and members; the potential consequences were more or less obvious.

Indeed, at the beginning of today's session, the presiding judge made the following statement this time:

“A report was filed stating that on Monday in the holding cell, Bora Kaplan threatened Fethi Koyuncu by saying, ‘I will kill your mother.’”

Following this statement, both Bora Kaplan and his lawyers requested to speak, but the judge did not allow it.

First, let us look at what was written in this report filed by a gendarmerie lieutenant. It stated:

“While I was taking the detainees of the Ayhan Bora Kaplan gang case to the courtroom on September 9, 2024, the detainee Bora Kaplan addressed the other detainee named Fethi Koyuncu by saying, ‘I will kill your mother.’ This report has been filed by me to document the situation.”

The time of the report is as important as its content; it was filed at 15:00. That is, after the presiding judge made those statements regarding Fethi Koyuncu's petition!..

The latest hot development in the scandal is this:

Defendant Fethi Koyuncu submitted a petition to the court at today's hearing, explaining both why he had submitted the whistleblower petition and stating that Bora Kaplan had not threatened him.

“My honorable presiding judge, everyone, including Bora Kaplan, was already aware that I had written the petition I submitted to your court. After learning that the police officers who set up the frame-up had been arrested, I took such an initiative on my own to prove that those who committed these irregularities were not limited to just a few people. For this reason, knowing that you were not in your office due to the judicial recess, I wrote it thinking that perhaps it would reach the ears of the police officers who framed me through the duty judge's office, and they would come to meet with me. If my plan had worked and they had come to meet with me, I would have said to them, ‘You already know that I don't know anything. You write whatever you want, and I will sign it.’ When the time came for me to give my statement, I would have exposed their frame-up to everyone, starting with your presidency. But when you became aware of the petition, you did what was fair as you should have and wanted me to speak in front of everyone in the courtroom, and I waited one more day hoping that perhaps the police would contact me. The whole matter consists of this. I apologize to your court presidency for wasting your valuable time.”

The Gendarmerie Misunderstood the Conversation

As for whether Bora Kaplan threatened him; Fethi Koyuncu explained the following regarding this in his petition:

“My judge, while Bora Kaplan was walking up the stairs, he said to me regarding this person I do not know, Muhammet Sağ, ‘This Muhammet Sağ is still slandering me, he supposedly sent word through a businessman friend of mine that I had his mother and father killed.’ Our commander perceived this topic as a threat to me. I am grateful to our commander for his sensitivity, but it is a complete misunderstanding. There is no threat to my life safety. My family is already in the courtroom. I hope for your understanding. The discretion belongs to your supreme presidency.”

Fethi Koyuncu also added a note in parentheses at the bottom of this petition. From the note, it is understood that he wanted to meet with the court bailiff. He explained the reason for this with that note as follows:

“The reason I wanted to meet with your bailiff was that I thought perhaps the police officers here would think I wanted to tell them something and would want to meet with me.”
