5 siblings had lost their lives in the fire! Indictment prepared: The requested sentence for the mother has been determined

The indictment regarding the fire tragedy in Selçuk, İzmir, which resulted in the deaths of five children aged between 1 and 5 who were left at home by their mother, has been completed. A prison sentence of 2 to 20 years has been requested for the mother for the crime of "causing the death of more than one person through conscious negligence." The indictment emphasizes that the mother should have foreseen that the electric heater could tip over and cause a fire, stating that she acted by 'relying on luck and other factors.'

THE MOTHER SHOULD HAVE FORESEEN THIS DANGER

In the indictment prepared by the Torbalı Chief Public Prosecutor's Office and submitted to the court, it was stated that the 5 children, the eldest of whom was 5 years old, were put to sleep by their mother, S.M.A., who then left the house after turning on the electric heater. The indictment points out that the mother should have foreseen the risk, as the children, due to their age, would not have known that the heater, which lacked a tip-over safety feature, could fall and start a fire.

SHE ACTED BY RELYING ON LUCK AND OTHER FACTORS

The indictment, which emphasizes that the incident occurred by relying on luck or other factors, notes that for these reasons, the suspect should be held responsible for the deaths of the victims, who were her own children, under the state of conscious negligence.

The indictment describes how the mother left her children home alone, after which the heater tipped over, causing a fire that led to the death of her own children due to smoke inhalation.

SHE EXPLAINED THAT SHE RECEIVED SOCIAL ASSISTANCE

The statements of the suspect, S.M.A., were also included in the indictment.

Stating that they made a living by collecting scrap, S.M.A. noted that she continued this work because her husband had gone to prison. Explaining that she had been receiving social assistance for about two years under the Turkey Family Support Program and for about a year from the Tire Social Services Directorate, S.M.A. stated the following:

"On the day of the incident, I put my children to sleep on a floor mattress and placed the electric heater in the middle of the living room and turned it on. Then, I took the scrap I had collected to the Selçuk Industrial Site with a handcart. When I arrived home, the fire had started. My children were lying motionless in their beds. I immediately took 2 of my children in one hand and my other older child in the other and took them out to the courtyard. When I returned, I took the remaining 2 children and brought them out to the courtyard. Then I called out to our neighbor and asked for help. I did not lock the door behind my children; I just pulled the door shut. The door had not had a handle on the inside for a long time. I only gave the handle to my eldest child, Fadime Nefes, and only she could open the door."

UP TO 20 YEARS IN PRISON REQUESTED

In the indictment, where a prison sentence of 2 to 20 years is requested for the mother for the crime of "causing the death of more than one person through conscious negligence," it was requested that the reduction provisions in Article 22/6 of the Turkish Penal Code (TCK) be applied to the suspect, as it was determined that she suffered victimization in terms of her personal and family situation.

WHAT HAD HAPPENED?

On November 11, 2024, in the Selçuk district, siblings Fadime Nefes (5), Funda Peri (4), Aslan Miraç (3), Masal Işık (2), and Aras Bulut Akcan (1), who were alone at home and affected by smoke, lost their lives in a fire that broke out in a house in the Cumhuriyet neighborhood. The mother, S.M.A., who was taken into custody and stated in her initial testimony that her husband was in prison and that she had left the house for a short time to collect money from a scrap dealer, was released under judicial control.
