AKP's Ravza Kavakcı files complaint against judge over unsatisfactory rulings; her testimony to the HSK revealed
AKP's Ravza Kavakcı, who made headlines after it was revealed she received thousands of dollars in scholarships from the Istanbul Metropolitan Municipality (İBB), had filed complaints regarding comments made about her. Dissatisfied with the acquittal rulings in the defamation cases she brought to court, Kavakcı filed a complaint against Judge Erdemli. Following Kavakcı's complaint, the HSK issued a penalty.
According to a report by Furkan Karabay from 10haber.net, it was determined that during the AKP era, a total of 61 million 499 thousand 893 TL in scholarships were granted to 34 individuals by the İBB. Among those who received "scholarships" was AKP MP Ravza Kavakcı. Once the amounts of the scholarships Kavakcı received were revealed, numerous comments were made about her.
Ravza Kavakcı took the reader comments on news reports regarding her receipt of 155 thousand dollars and 59 thousand liras in scholarships from the Istanbul Metropolitan Municipality (İBB) during the AKP era to court.
TOOK COMMENTS ON NEWS REPORTS TO COURT
Many news reports were published and social media posts were made regarding the revelation that Ravza Kavakcı had received thousands of dollars from the İBB.
Ravza Kavakcı filed a complaint regarding reader comments made on a Facebook post stating, "It has been revealed that an AKP MP received a salary from the İBB.
It is seen that AKP Istanbul MP Ravza Kavakcı is still on the payroll of Metro Tur A.Ş, an İBB subsidiary."
Following Kavakcı's complaint, lawsuits were filed against those who made comments such as "Wahhabi, Islamist, fraud, prostitute" on news reports and posts regarding her receipt of thousands of dollars from the İBB.
In the cases heard at the Istanbul Anatolian 29th Criminal Court of First Instance, Judge Mahmut Erdemli issued acquittal rulings. After the acquittal rulings were overturned by the appellate court, Kavakcı filed a complaint against Judge Erdemli with the HSK.
HSK LAUNCHED AN INVESTIGATION INTO THE JUDGE WHO ISSUED THE ACQUITTAL
Judge Erdemli, who was subjected to an investigation launched by the HSK, was asked why he issued acquittal rulings in the defamation cases in which Kavakcı was the complainant. In his defense to the HSK, Erdemli stated that social media accounts could be hacked by others, and that it could not be determined whether a person made a post simply by physically examining a phone or computer.
In his defense, Erdemli stated that he could not be convinced that the suspects had committed defamation, and that since there was no admission from them that they had made the posts, he issued acquittal rulings.
Stating that he has been a criminal judge of first instance for 21 years, Erdemli noted that there were dozens of files in the court where he served in which Kavakcı was a party, and that he had also issued conviction rulings in many of those cases.
The Second Chamber of the HSK, chaired by HSK Deputy Chairman Mehmet Akif Ekinci, ruled by majority vote to impose a penalty on Judge Erdemli for failing to issue the rulings desired by Kavakcı, who was revealed to have received thousands of dollars from the İBB.
