AKP Chairman and President Recep Tayyip Erdoğan has once again amended the "Regulation on Mobilization and State of War," which came into effect last year with his signature and transferred the authority to declare mobilization directly to the President. The new regulation covers the personal rights of reserve personnel during their participation in exercises and training processes.

According to the report by Sibel Yüklüer from T24, with the regulation that was renewed and put into effect last year after a 34-year hiatus, the authority to declare mobilization was taken from the Council of Ministers and transferred to the President. Moreover, one of the most notable innovations in the new regulation was the provision allowing for the declaration of mobilization in extraordinary situations such as "uprisings and strong or active insurrections." In such a situation, the President will now be able to make a direct decision, and this decision will be submitted to the Turkish Grand National Assembly (TBMM) for approval after being published in the Official Gazette.

THOSE DISMISSED WILL ALSO BECOME RESERVE PRIVATES

One of the striking articles in last year's regulation concerned the status of those dismissed from the Turkish Armed Forces, public service, or their professions via Statutory Decrees (KHK) during states of emergency. It was stated that if these individuals are found to have "affiliation or connection with terrorist organizations or structures against the national security of the state," they could be called up for duty as "reserve privates" in cases of mobilization and war. Similarly, individuals who have received sentences from military or civilian courts may also be included in the "reserve personnel" status.

LATEST AMENDMENT: DETAILS REGARDING PERSONAL RIGHTS

The "Regulation on Amending the Regulation on Mobilization and State of War," which was published in the Official Gazette dated May 1 and bears Erdoğan's signature, specifically amended Article 95, which regulates the rights of reserve personnel participating in mobilization exercises and individual mobilization training.

Accordingly, during the exercise and training period, if the salary or monthly payment that reserve personnel receive from their respective institutions is lower than their rank salary, the difference in salary and social security premiums will be paid by the Ministry of National Defense. Those covered under this scope include reserve officers, reserve non-commissioned officers, reserve expert gendarmerie, reserve expert sergeants, and reserve contract sergeants and privates.

However, no additional payment will be made to those whose salary from their workplace is higher than their rank salary. On the other hand, for personnel who do not receive a full salary from their workplace and do not fall under the aforementioned clause, the rank salary will be paid directly by the ministry.

For reserve privates and sergeants who do not continue to receive a salary from their workplace, a daily payment will be made at the rate of one-thirtieth of the minimum wage applied to single workers over the age of 16.

DECLARATION WILL BE TAKEN AS BASIS, PENALTIES FOR IRREGULARITIES

In order for these payments to be made, reserve personnel must submit documents showing the salaries and wages they receive from their institutions. However, if a document cannot be presented, the personnel's declaration will be taken as the basis. Nevertheless, administrative and judicial proceedings will be initiated against those found to have made false declarations.

Finally, a clear regulation was also made regarding travel expenses. While the travel expenses of reserve sergeants and privates are covered according to Article 102 of the Recruitment Regulation, the travel allowance for reserve officers, non-commissioned officers, and other ranked reserve personnel will be paid according to the Travel Allowance Law No. 6245.
