Another court ruling of absolute nullity regarding a political party

The judicial process regarding the Motherland Party's grand congress held on December 24, 2023, has concluded. The Ankara 47th Civil Court of First Instance has decided to cancel the congress.

While the effects of the absolute nullity ruling regarding the CHP's 38th Ordinary Congress continue to dominate the political agenda, a similar process has now occurred within the Motherland Party. It is stated that the court's decision could have significant consequences for the party's administration and the new congress process.

CONGRESS PROCESS TAKEN TO COURT

Sedat Kapıdağ, a member of the Motherland Party's Central Decision and Executive Board (MKYK) and Deputy Chairman in charge of Election Affairs, took the process regarding the grand congress held on December 24, 2023, to court.

The petition submitted by Kapıdağ included allegations that forged signatures were cast on behalf of some delegates. Following the allegations of irregularities in the congress process, the matter was submitted for judicial review.

CRIMINAL INVESTIGATION CONDUCTED

It was stated that within the scope of the case, the attendance lists and delegate signatures regarding the congress were subjected to a criminal investigation. It was alleged that examinations conducted by experts identified that some signatures were forged.

It was stated that these examinations were included in the court file and evaluated during the decision-making process.

CANCELLATION DECISION FROM THE COURT

According to information provided by TGRT Ankara News Coordinator Ahmet Sözcan, the Ankara 47th Civil Court of First Instance ruled for the cancellation of the Motherland Party's 2023 grand congress.

It was learned that the court's decision included an assessment that the situation regarding some delegates who voted in the congress was of a nature that could affect the election result.

The decision drew attention to the reasoning that some delegate votes deemed invalid had a direct impact on the outcome of the chairmanship election. In this context, it was assessed that the result regarding İbrahim Çelebi's election as chairman was also affected.

NEW CONGRESS PROCESS ON THE AGENDA

According to the allegations, an application will be made to the Supreme Election Council (YSK) after the court decision is served to the parties. It is stated that in the continuation of the process, a request will be made for the appointment of a call committee to take the party to a new congress.

It is stated that if a call committee is appointed, it is expected that a new congress process will be initiated within approximately 45 days.
