Baby who spent 47 days in hospital in Şanlıurfa returned to family with a broken leg and bruises on their head! Ministry of Health denied permission for investigation

In Şanlıurfa, the couple S.P. and B.P. struggled for 13 years to have a baby. The couple, who had twins via IVF on August 24, 2022, had one of their babies, B., stay for 47 days at the private U.L. Hospital where the mother gave birth. 

On October 9, 2022, the father, S.P., was suddenly called and told, 'you can come and pick up the child.' When he arrived, he received his baby with their hair shaved, multiple IV lines inserted into their head, and their leg bruised black and blue. Following this, the family applied to the Şanlıurfa Chief Public Prosecutor's Office and filed a criminal complaint against the suspects for the crime of 'misconduct in office.'

The incident was described as follows in the criminal complaint:

"THE BABY'S LEG HAD TURNED BLACK AND BLUE"

-The victim baby B., whom he had left at the hospital completely healthy and sound, had their hair shaved, multiple IV lines inserted into their head, and the baby's leg was bruised black and blue. 

-He stated that he wanted to see the doctor who had been involved with the birth and the baby, Dr. İ.Y., but no matter how much he insisted, the doctor did not meet with him, and the nurses practically kicked the client out of the hospital. 

-The family, who picked up the baby on Sunday, saw that the baby was crying constantly and appeared to be fainting, so they went to the private Metrolife Hospital in a rush on Monday and experienced a great shock.

"THE BABY'S HAIR WAS SHAVED AND IV LINES WERE INSERTED, THERE ARE CRUSH-LIKE MARKS ON THEIR BODY"

-For if the documents and the CD we submitted to the file are examined, it is learned that the victim baby B.'s leg is full of fractures starting from the knee. Likewise, there are crush-like marks on many parts of the baby's body, and the baby's current condition is heartbreaking. 

-Again, suspecting that there might be problems with the baby's head or skull due to the shaving of the baby's hair, the insertion of IV lines, and the presence of many butterfly needle marks, they made an appointment for October 16, 2022, for a head and skull check. Although the client father S.P. has been calling the Private U.L. Hospital for days trying to learn what was done to his baby, no information is provided, and the phones are hung up on him every time.

-The duty of disclosure, which is the most important obligation of doctors and the hospital, has been violated, and no information has been given regarding how a father's newborn baby ended up in this state. For all the reasons explained above, it has become necessary for us to request that an investigation be conducted into the suspect(s) for the relevant crimes and that a public lawsuit be filed. Therefore, we demand that the suspects be punished in the most severe manner."

MINISTRY OF HEALTH DENIED PERMISSION FOR INVESTIGATION

Following the family's criminal complaint, the Şanlıurfa Chief Public Prosecutor's Office wrote to the Ministry of Health's Professional Liability Board requesting permission to investigate the suspected healthcare workers. On July 11, 2023, the Ministry of Health announced that it did not grant permission for an investigation on the grounds that "there was no fault in the actions of those complained about in the incident." Due to the Ministry's refusal to grant permission for an investigation, the Prosecutor's Office decided to close the file on behalf of the public on April 30, 2024.
