Breaking News: Constitutional Court ruling on CHP Congress file

An indictment was prepared against 12 people on charges of 'rigging a vote' regarding allegations that 'votes were cast in exchange for money' at the CHP's 38th Ordinary Congress, with prison sentences of 1 to 3 years requested for the suspects.

COURT'S LACK OF JURISDICTION RULING

The Ankara 26th Criminal Court of First Instance, which accepted the indictment, issued a lack of jurisdiction ruling, stating that the bribery allegations should also be investigated, and sent the file to the High Criminal Court.

MATTER MOVED TO THE CONSTITUTIONAL COURT

The Ankara 3rd High Criminal Court ruled that the case should be heard at the 26th Criminal Court of First Instance, and the final decision on the dispute was made by the 5th Criminal Chamber of the Ankara Regional Court of Justice. This court had decided that the file should be heard again at the Ankara 26th Criminal Court of First Instance. Following these developments, the 26th Criminal Court of First Instance moved the file to the Constitutional Court (AYM).

CANCELLATION OF THE RULING REQUESTED

The court requested the cancellation of the provision stating that 'only the appeal path can be taken against lack of jurisdiction rulings issued regarding courts within the judicial jurisdiction' on the grounds that it is unconstitutional.

APPLICATION REJECTED

The High Court, which took up the application made by the 26th Criminal Court of First Instance for the cancellation of the ruling on its agenda today, rejected the court's application.
