5.5 million lira administrative fine from the Capital Markets Board
The Capital Markets Board (SPK) has decided to impose a total administrative fine of 5 million 468 thousand 630 lira on 2 individuals and 2 legal entities.
According to the SPK's weekly bulletin, the board approved the 25 million lira capital increase application of Mega Polietilen Köpük Sanayi ve Ticaret.
The SPK, which decided to approve the requests for the establishment of venture capital investment trusts titled Ahlatcı Girişim Sermayesi Yatırım Ortaklığı AŞ and Pasifik Girişim Sermayesi Yatırım Ortaklığı AŞ, also approved the request for the establishment of the Kuveyt Türk Portföy Yönetimi AŞ Fund Basket Umbrella Fund by Kuveyt Türk Portföy Yönetimi AŞ.
The SPK also decided to approve the request of Argeus Gayrimenkul Portföy Yönetimi AŞ for an operating license and a portfolio management authorization certificate.
The Board, which approved the request of Bankpozitif Kredi ve Kalkınma Bankası AŞ to engage in activities including brokerage for order transmission, transaction brokerage, portfolio brokerage, individual portfolio management, investment consultancy, and brokerage for public offerings through underwriting in addition to its existing operating licenses, also authorized the establishment of the crowdfunding platform titled Fonventure Kitle Fonlama Platformu AŞ.
The SPK also decided to remove IHY Bağımsız Denetim ve Yeminli Mali Müşavirlik AŞ from the List of Organizations Authorized for Independent Audit in the Capital Markets upon its own request.
ADMINISTRATIVE FINES
As a result of the investigation conducted regarding the transactions carried out in the Türker Proje Gayrimenkul ve Yatırım Geliştirme AŞ share market between July 27, 2022, and August 5, 2022, the Board decided to impose a total administrative fine of 2 million 109 thousand 65 lira on 2 individuals, and ruled that an administrative fine of 3 million 150 thousand 216 lira be imposed on İnfo Yatırım Menkul Değerler and 209 thousand 349 lira on Metrik Gayrimenkul Değerleme Danışmanlık.
Thus, the SPK decided to impose a total administrative fine of 5 million 468 thousand 630 lira on 2 individuals and 2 legal entities.
The Board decided to file criminal complaints against 15 individuals, 8 internet content providers, and the person who allowed their registered phone line to be used, and ruled that necessary legal actions be taken to block access to 25 websites determined to be facilitating leveraged trading abroad via the internet for residents in Turkey.
The SPK also enabled capital market institutions, organizations, and partnerships to make their applications more quickly and effectively through the e-Application System.
In this direction, starting from April 15, 2024, it will be mandatory for issuers, institutions, and organizations within the scope of the Central Registration System (MERSİS) to make applications to the Board that fall under the scope of the Partnerships Finance Department electronically via the e-Application System.
However, in cases of force majeure such as fires, natural disasters, states of war, terrorist incidents, other developments that could significantly affect the sustainability of operations, unavoidable technical disruptions in internet connections, and situations where the information systems of the notifying parties become dysfunctional for reasons not attributable to them, applications may also be made physically with wet signatures.
