CHP requests defense from Gürsel Tekin

The Republican People's Party (CHP) submitted its petition today against the preliminary injunction decision dated September 2, 2025, issued by the Istanbul 45th Civil Court of First Instance. The CHP stated that the decision in question is contrary to the Constitution, the Law on Political Parties, and the fundamental principles of election law, and requested that the injunction be lifted.

Gürsel Tekin is required to submit his defense within 15 days.

On the other hand, the Republican People's Party (CHP) submitted its petition today against the preliminary injunction decision dated September 2, 2025, issued by the Istanbul 45th Civil Court of First Instance.

The petition recalled that objections regarding elections held at political party congresses can only be made to election boards. It was emphasized in the petition that although the court lacked jurisdiction in this area, it dismissed party organs and appointed a temporary board, and the following statements were included: “This decision is a usurpation of authority unprecedented in the history of the Turkish judiciary. The court has placed itself in the position of an election board and interfered with election results. The congress elections were held under the supervision of the district election board and were finalized with the issuance of the certificate of election. Despite this, the decision rendered by the court is clearly contrary to the law.”

"PARTY ORGANS HAVE BEEN LIQUIDATED"

In the petition, it was emphasized that the decision was not based on any concrete evidence, stating, “A congress of the country's leading party has been canceled, but it has not been demonstrated with what concrete evidence these decisions were made,” and added, “The claim of corruption of will has not been substantiated. There is no finding that any delegate voted against their will.”

"PART OF THE PROCESS"

The petition, which stated that the decision was directed not only at the Republican People's Party but at the democratic order in Turkey, included the following statements: “The situation faced in the case is part of a process of de-constitutionalization. A decision that could not be obtained from the election judiciary was attempted to be obtained from the civil court. The requests that were rejected in nine previously filed lawsuits were accepted through an injunction in the tenth lawsuit. Thus, Articles 67 and 68 of the Constitution have been bypassed.

The decision rules on who will manage the party. The possibility has arisen that persons determined by the court, instead of elected officials, will manage the party for years. This situation is contrary to the principle that political parties are managed by their own will.

If this decision is taken as a precedent, the cancellation of even presidential and parliamentary elections by civil courts could come onto the agenda.

The preliminary injunction decision dated 02/09/2025 is as contrary to reason and logic as it is to the Constitution and the Law on Political Parties. This decision is null and void. The CHP, as an indispensable element of democratic political life, cannot be liquidated by the judiciary.”
