CHP takes action: New move from the opposition against trustees

While discussions continue regarding the arrest of CHP's Esenyurt Mayor Ahmet Özer and the appointment of a trustee in his place, trustees have also been appointed to the DEM Party-run municipalities of Mardin, Batman, and Halfeti. 

A new move has come from the CHP to repeal the regulation that forms the basis for appointing trustees to municipalities.

According to a report by Ceren Bayar from Gazete Duvar, the CHP has held contacts for a legislative proposal that all political parties in the TBMM could agree upon.

The representatives of the DEM Party, the IYI Party, and the Saadet-Gelecek group, with whom the CHP held meetings, expressed the view that trustee practices are anti-democratic.

It was observed that the party groups are in consensus on the need for a legal regulation to remove the relevant paragraph in the Municipal Law that enables the trustee practice. While the DEM Party and the CHP currently have legislative proposals on the matter, it was noted that the IYI Party and the Saadet-Gelecek Group will also prepare their own proposals.

DEM PARTY'S PROPOSAL WITH THE SAME CONTENT

The DEM Party, which views the CHP's proposal favorably, stated that they already have a legislative proposal with the same content and that they could join forces with other parties if a consensus is reached.

IYI PARTY WILL SUBMIT ITS OWN PROPOSAL

The IYI Party stated that instead of joining a single legislative proposal, they will submit a new legislative proposal they have prepared themselves to Parliament.

The Saadet-Gelecek Group also conveyed the view that there is a need for legal regulation. Officials from the Saadet-Gelecek Group, who will prepare a legislative proposal with the same content, stated that they have not yet made a decision on whether the proposal will be submitted jointly or as a party, and that negotiations are ongoing. Saadet-Gelecek Group officials said that even if they submit the proposal as a party rather than jointly, since the legislative proposals will have the same content, all proposals will be merged if they are brought to the agenda.

CHP executives also met with AKP and MHP group executives as part of their contacts.

TWO SEPARATE LEGISLATIVE PROPOSALS IN PARLIAMENT

There are currently two separate legislative proposals in Parliament for the repeal of this regulation. The legislative proposals of the CHP and the DEM Party suggest the complete repeal of the relevant paragraph.

CHP: A HUMANITARIAN DISASTER THAT SURPASSES PRIMITIVENESS

The justification for the CHP's proposal includes the following statements:

“If the claim is terrorism, one must fight even against terrorism not by excluding the universal principles of law, but by remaining within the law, and one must fill the positions of those removed from office not by appointment, but by going to elections again. The personal nature of crime has always been a universal principle of law that transcends political regimes at all times. Punishing all individuals who make up a human community by disregarding their rights, legal capacity, and the right to vote and be elected due to a crime allegedly committed—or even proven—by one or more persons is a humanitarian disaster that surpasses even primitiveness.”

DEM: MUNICIPALITIES THAT COULD NOT BE WON THROUGH ELECTIONS WERE OBTAINED THROUGH TUTELAGE

In the justification of the DEM Party, it is stated: “The negative reflections of the trustee practice on local governments, the fact that it allows municipalities that could not be won through elections to be obtained through tutelage, and the destruction created by trustees in the localities where they are appointed have made it mandatory to make a regulation to remove this practice from the legislation.”
