Court of Cassation upholds prison sentence for individual who used Photoshop to alter medical report to skip work

The 11th Criminal Chamber of the Court of Cassation has upheld a 2-year and 1-month prison sentence given for the crime of "forgery of an official document" to an individual who used Photoshop to create a fake medical report to avoid going to work.

According to the chamber's ruling, an individual working as an emergency medical technician in Kırıkkale used the Photoshop program to change the dates on a 30-day medical leave report issued after their surgery, creating a fake 20-day report to avoid going to work.

In the subsequent process, the individual created a 6-day fake report following a 1-day report issued after an examination, and later created a 20-day report using the Photoshop program again after receiving a 10-day report from a private hospital.

A criminal complaint was filed against the individual after it was discovered that the reports they submitted to their institution to avoid work were forged.

Following the investigation, a public lawsuit was filed against the individual for "forgery of an official document," and they were sentenced to 2 years and 1 month in prison by the Sulakyurt Criminal Court of First Instance.

Following the verdict, the defendant's lawyer appealed the local court's decision, arguing that "the documents produced did not have the quality of deception and that the elements of the crime of forgery were not formed."

The 11th Criminal Chamber of the Court of Cassation, which conducted the appeal review, ruled that the procedures during the trial process were carried out in accordance with the law and procedure. The chamber stated that it was established that the act was committed by the defendant and upheld the sentence given.
