Critical Can Atalay meeting at the Constitutional Court

Critical Can Atalay meeting at the Constitutional Court

Can Atalay, who was arrested on April 25, 2022, had applied to the Constitutional Court after his trial was not suspended and a verdict was reached against him despite his election as a TİP MP for Hatay. 

The high court issued a violation ruling and sent the file to the local court for Atalay's release and the suspension of the trial. The Istanbul 13th High Criminal Court, however, sent the file to the Court of Cassation's 3rd Criminal Chamber on the grounds that a verdict had already been reached for Atalay. The chamber, which “did not comply with the violation ruling,” filed a criminal complaint against the AYM members who voted in favor of the violation.

IT HAD CAUSED A CRISIS IN THE JUDICIARY

While reactions to the event that caused a 'judicial crisis' continue, Atalay's lawyers have once again applied to the high court this time due to the non-compliance with the AYM's ruling.

IT WILL BE DECIDED TODAY

The first section of the Constitutional Court, which examined the application, unanimously referred the file to the AYM General Assembly. The General Assembly, which has added the file to its agenda, is expected to reach a decision on Atalay's application today.
