Details of the framework law for the second opening process have emerged: Here are the key points

Eyes have turned to legal regulations in the second opening process, which is architected by MHP leader Devlet Bahçeli and dubbed 'Terror-Free Turkey' by the government, involving the DEM Party and the leader of the PKK terrorist organization, Abdullah Öcalan.

According to NTV, while the framework law regulation is planned to be enacted before the summer period, it is stated that the practices to be put into effect will be conditional upon the fulfillment of certain requirements.

SECURITY INSTITUTIONS' CONFIRMATION WILL BE AWAITED FOR IMPLEMENTATION

According to the prepared roadmap, the framework law will be passed by Parliament, but the implementation process will begin only after developments on the ground are evaluated by the National Intelligence Organization (MİT) and the Turkish Armed Forces (TSK).

Following this stage, the National Security Council (MGK) is expected to issue a confirmation decision stating that "the PKK has been dissolved and arms have been laid down." In the final step of the process, a Presidential decree will be published.

THOSE SERVING AGGRAVATED LIFE SENTENCES ARE EXCLUDED

It is stated that the regulation does not foresee any special provision for the leader of the PKK terrorist organization, Abdullah Öcalan, or the organization's so-called leadership cadre. Furthermore, it is noted that those sentenced to aggravated life imprisonment will not be able to benefit from the regulation.

It is assessed that for members of the terrorist organization who wish to return to Turkey, it may be possible for them to avoid punishment by benefiting from the effective remorse provisions in the Turkish Penal Code, provided they have not been involved in any crimes within the scope of organizational activities.

LIMITATIONS ON JUDICIAL CONTROL AND PUBLIC SERVICE

The files of terrorist organization members accused of crimes will be examined individually by the courts. It is planned that terrorists returning to Turkey will be subject to judicial control measures for a period of 3 or 5 years.

The prepared regulation is also expected to include provisions stating that these individuals will not be able to hold positions in any public institution or engage in politics during the judicial control period.
