Ministry of National Education publishes new regulation for contract teachers: Conditions announced

The Regulation on the Employment of Contract Teachers by the Ministry of National Education has been published in the Official Gazette and has entered into force. The Regulation on the Employment of Contract Teachers, published in the Official Gazette dated 3/8/2016 and numbered 29790, has been repealed.

With the new regulation, the procedures and principles regarding the determination of teacher candidates to be admitted to preparatory training at the National Education Academy and the employment of contract teachers in official educational institutions affiliated with the Ministry of National Education have been regulated.

ACADEMY ENTRANCE EXAM

The Ministry of National Education Academy Entrance Exam (MEB-AGS) will be conducted by ÖSYM to determine those who will be admitted to preparatory training at the Academy. The scope of the MEB-AGS will be determined based on the teaching profession competencies, which include the knowledge, skills, attitudes, and values required by the teaching profession.

According to the report by ANKA, the content of the MEB-AGS, its location and time, the announcement of the exam, the subjects and tests to be included in the exam and their weightings, score types and calculation methods, the education level of applicants, the application procedure for candidates, the use of scores obtained from the exam for admission to preparatory training, the notification of exam results to candidates and institutions, and other matters related to the exam will be determined jointly by the Ministry and ÖSYM.

The exam guide will be prepared and published by ÖSYM in accordance with these determined matters.

MEB-AGS scores will be valid from the date the results are announced until the results of the next exam are announced.

The dates for the MEB-AGS will be determined jointly by the Ministry and ÖSYM. ÖSYM will announce the MEB-AGS date, application date, and how and where to apply in the Official Gazette, on the website of the institution determined by the President, and on its own website.

The application document will be prepared by ÖSYM in a content that will ensure the inclusion of candidates' detailed identity information, education level, and information regarding their fields of study, as well as other necessary personal qualifications.

CONDITIONS TO BE SOUGHT

In addition to the conditions specified in Article 9 of Law No. 7528, the following conditions will be sought for those to be admitted to preparatory training:

To have graduated from higher education programs at least at the undergraduate level that constitute a source for the teaching profession or from equivalent foreign higher education programs.

To have received a score at or above the base score determined in their fields from the EKPSS for disabled candidates and from the MEB-AGS for other candidates.

For those who were previously appointed as contract teachers to the Ministry, one year must have passed since the date of their placement in terms of those who did not start their duty without an excuse and those who left their duties without an excuse despite having started.

To have obtained a health board report stating that they can perform the teaching profession.

WHO WILL BE ADMITTED TO PREPARATORY TRAINING?

The number of quotas determined by field for those to be admitted to preparatory training to be appointed as contract teachers, the base exam score, the place and duration of application, and other matters related to the application will be specified in the announcement to be made by the Ministry.

Those who meet the conditions sought for admission to preparatory training will be able to apply for admission to preparatory training within the period specified in the announcement. Those whose education is a source for more than one field will be able to apply for only one of these fields.

EMPLOYMENT AS CONTRACT TEACHERS

Those who successfully complete the preparatory training will be employed as contract teachers within the scope of paragraph (B) of Article 4 of Law No. 657, provided that they meet the conditions specified in subparagraphs (a), (b), (c), (ç), (d), and (g) of the first paragraph of Article 9 of Law No. 7528 and that a security investigation and archive research have been conducted in accordance with Law No. 7315.

The placement of teacher candidates in educational institutions in line with their preferences will be carried out according to the superiority of the success score for appointment determined according to the third paragraph of Article 10 of Law No. 7528. In case of equality of the success score for appointment, priority will be given to the one with the higher MEB-AGS score. If the equality is not broken in this way, the candidate to be placed will be determined by a computer-based draw.

Those who do not make a preference and those who cannot be placed in their preferences will be given the right to make a new preference for the remaining vacant educational institutions, and placements will be carried out according to the procedure specified in the second paragraph. Those who do not make a preference in the second preference period and those who cannot be placed in their preferences will be placed by the Ministry by draw.

Applications for those to be employed as contract teachers will be received electronically, and the placement process in educational institutions will be completed within two months from the end of the preparatory training.

Application dates, documents to be requested from applicants regarding the conditions specified in the first paragraph, and other matters regarding placement will be specified in the announcement to be made by the Ministry.

TEACHERS IN EXCESS OF NORM STAFF

In case of an excess of norm staff due to a change in the number of norm staff of the educational institution, contract teachers will be determined as teachers in excess of norm staff first.

In case there is more than one contract teacher in the field where there is an excess of norm staff, respectively; the one with the lower service period in contract teaching, the one who started contract teaching later, and the one with the lower score for appointment will be determined as the teacher in excess of norm staff.

Contract teachers who are in excess of norm staff will be appointed by the governorships to educational institutions where there is a need in their fields, taking into account their preferences and according to the superiority of service period. In case of equality of service periods, respectively; the one who started contract teaching earlier and the one with the higher score for appointment will be appointed.

The appointments of those who do not make a preference and those who cannot be placed in their preferences will be made ex officio by the relevant governorships, prioritizing educational institutions with vacant norm staff within the same district group.

In case the appointment of the contract teacher cannot be made within the scope of the third paragraph, five provinces with the highest need for teachers in their field will be presented to their preference by the Ministry.

The appointment process will be carried out in line with the teacher's preference. The appointment of the teacher who does not make a preference will be made ex officio by the Ministry.

RELOCATIONS

Among the contract teachers who are proposed to be relocated as a result of judicial or administrative investigations conducted about them, the appointments of those whose duty location will be changed within the province will be made by the governorships, and the appointments of those whose duty location will be changed outside the province will be made by the Ministry to one of the educational institutions in need of teachers.

DUTY AND RESPONSIBILITY

Contract teachers will be obliged to fulfill the duties and responsibilities foreseen for permanent teachers working in their field. No duty other than teaching duty or educational institution management within the scope of the second duty can be given to contract teachers.

CONTRACT DURATION

Contracts with contract teachers are made limited to the fiscal year. The contract periods of those whose contracts are not terminated will also be valid for the following year. A new contract is made between the contract teacher whose duty location has changed within the scope of this Regulation and the provincial/district national education directorate to which the educational institution they are appointed to is affiliated. This contract to be made will be in the nature of a continuation of the old contract.

APPOINTMENT TO TEACHER STAFF

Contract teachers who complete a three-year working period will be appointed to teacher staff in the place where they work upon their request. Those appointed to teacher staff will not be able to relocate for one year, except for relocations based on excuses.

In cases where there is no provision in this Regulation, Law No. 657, Law No. 7528, and the Principles Regarding the Employment of Contract Personnel will be applied.
