Possible scenarios revealed ahead of the 'absolute nullity' lawsuit! Two options await the CHP

The 'absolute nullity' lawsuit filed to cancel the Republican People's Party (CHP) 38th Ordinary Congress and transfer the administration to Kemal Kılıçdaroğlu has reached a significant stage. The lawsuits filed by former Hatay Mayor Lütfü Savaş and several delegates for the cancellation of the CHP's congress held on November 4-5, 2023, were consolidated at the Ankara 42nd Civil Court of First Instance.

The legal process gained momentum with the hearing held on June 30. However, as no decision was reached at that hearing, the court set a new hearing date for September 15. 

THE DEBATE OVER TRANSFER TO KILIÇDAROĞLU

Former CHP Chairman Kemal Kılıçdaroğlu's openness to taking over the party leadership following an 'absolute nullity' ruling has sparked debate within the party.

It is stated that the background to these developments involves the tension surrounding the change in management within the CHP and political pressure exerted by the government through legal channels. Furthermore, it is noted that there is a trend suggesting that court rulings issued to date have leaned toward 'absolute nullity'.

TWO OPTIONS AWAIT THE CHP

The key to the court's decision at the September 15 hearing lies in the word 'injunction.' If the court does not issue the absolute nullity ruling with an injunction, the current administration will remain in office. On the other hand, if the decision is postponed until the end of November, the grounds for the lawsuit will disappear. It is stated that the CHP Headquarters is focusing heavily on these two possibilities.

According to the report by Başak Kaya from Sözcü,it is also being discussed that behind this expectation of the CHP Headquarterslies the government's efforts to divide and transform the opposition partythroughlegal means.

HERE ARE THE 5 SCENARIOS ON THE TABLE

1 - On September 15, the court may issue the absolute nullity and injunction rulings simultaneously. Kılıçdaroğlu and the former Party Assembly members would return.

2 - If absolute nullity is ruled but no injunction is granted, the headquarters will appeal to a higher court. The appellate and Supreme Court processes could take years. Kılıçdaroğlu would not be able to return.

3 - If only an injunction is issued, the administration would be transferred to a call committee. The current administration would continue, and the call committee would go to a congress within 45 days.

4 - If the case is postponed until the end of November, the risk of nullity disappears. Once the congress is held, the term of the delegates who are the subject of the lawsuit ends, and the conditions for the complaint are removed.

5 - It is stated that even in the event of a 4-5 day postponement for the purpose of evaluating defenses, an absolute nullity ruling could still be issued.
