The remarks made by Yıldırım about Kütahyalı in 2019 were evaluated by the court as falling within the scope of freedom of expression, and it was determined that no criminal sanction was necessary.
YILDIRIM'S WORDS HAD BECOME THE SUBJECT OF A LAWSUIT
In 2019, Aziz Yıldırım had used the following expressions regarding Rasim Ozan Kütahyalı: "There cannot be such stupidity. I call it immorality. They put the bottle underneath, drink whiskey, and make comments."
The Istanbul Anatolian 37th Criminal Court of First Instance had sentenced Yıldırım to 105 days of judicial imprisonment for the crime of "public insult" due to these words. Because he had no prior criminal record, the sentence was reduced to 87 days and converted into a judicial fine of 3 thousand 480 liras.
CRIMINAL SANCTION LIFTED WITH AYM DECISION
However, in its final review, the Constitutional Court stated that these expressions by Yıldırım were within the scope of freedom of expression and decided that no criminal sanction was necessary. Thus, the sentence previously given to Yıldırım has become void.
