Kayserispor issues statement on Ali Koç ahead of Fenerbahçe match
Kayserispor, issuing a statement ahead of the Fenerbahçe match, addressed allegations regarding debts circulating on social media and the legal process involving former president Berna Gözbaşı.
Süper Lig side Kayserispor has responded with a written statement to allegations regarding bank debts that have surfaced on social media ahead of their match against Fenerbahçe.
The statement highlighted details of the legal disputes between the club and former president Berna Gözbaşı, as well as the status of Yapı Kredi Bank as a creditor.
Kayserispor’s statement is as follows:
“In recent days, various statements have been made through different channels regarding the legal situation between Yapı Kredi Bank and Kayserispor. Therefore, it has become necessary to make a statement to ensure the matter is correctly understood by the public.
An assignment of receivables is a transaction where a creditor transfers an existing receivable to a third party, and the assignee, by stepping into the shoes of the assignor, gains the right to claim against the debtor.
The receivables of our former president Berna Gözbaşı from our club are related to the assignment of our rights and receivables before the Turkish Football Federation (TFF) in favor of Berna Gözbaşı in exchange for these debts. The ongoing legal disputes on this matter are known to the public.
However, independent of the legal debates, the rights and receivables in question were transferred by Berna Gözbaşı to Yapı Kredi Bank, and with this transfer, the bank has attained the status of creditor over the rights subject to the assignment. As of today, the beneficiary of the assignment and the creditor of our club's rights and receivables is Yapı Kredi Bank.
On the other hand, it is understood that Fenerbahçe President Ali Koç is extremely knowledgeable about the accounting information of the companies belonging to our former president Berna Gözbaşı, as brought to the agenda by his statements. However, the parties involved in this matter are only Berna Gözbaşı and Kayserispor. Ali Koç making statements on a matter to which he is not a party reveals the fundamental contradiction of his own claims.
In conclusion, Yapı Kredi Bank is the creditor of our club. We present to the public the fact that the bank possesses all rights of disposal regarding the legally contested transfer and assignment process.”
