Kılıçdaroğlu to pay 100 thousand lira in non-pecuniary damages to Akar

Former CHP Chairman Kemal Kılıçdaroğlu has been sentenced to pay 100 thousand lira in non-pecuniary damages to Hulusi Akar, Chairman of the Turkish Grand National Assembly (TBMM) National Defense Commission and AK Party Kayseri Deputy, on the grounds that he attacked his personal rights during his parliamentary group speech on January 10, 2023.

Kılıçdaroğlu to pay 100 thousand lira in non-pecuniary damages to Akar

Lawyers for both parties attended the hearing at the Ankara 36th Civil Court of First Instance.

Akar's lawyer stated that his client's personal rights were violated by the statements in question and requested compensation for the non-pecuniary damage, while Kılıçdaroğlu's lawyer argued that the statements fell within the scope of freedom of expression and did not contain insults.

Judge İbrahim Enes Çelik announced that he had accepted the case and ruled that Kılıçdaroğlu must pay 100 thousand lira in non-pecuniary damages to Akar, that Kılıçdaroğlu be "reprimanded" in accordance with Article 58/2 of the Turkish Code of Obligations, and that a summary of the verdict be published in the two newspapers with the highest circulation.

Akar's lawyer, Samet Can Olgaç, had filed a lawsuit for 100 thousand lira in non-pecuniary damages on the grounds that Kılıçdaroğlu had made "severe insults and accusations" against Akar, who was the Minister of National Defense at the time, during his party's parliamentary group meeting on January 10, 2023.

The petition for the lawsuit had also requested that Kılıçdaroğlu be "reprimanded" and that the decision regarding this be published in the two newspapers with the highest circulation.
