Narin Güran murder: 'A weak indictment'

The indictment against 4 suspects regarding the murder of 8-year-old Narin Güran, whose lifeless body was found 19 days after she went missing in Tavşantepe Neighborhood in the Bağlar district of Diyarbakır, was completed on the 60th day. Lawyer Abdurrahman Karabulut explained the details of the indictment, which is the target of criticism, to 12Punto.

Aggravated life imprisonment was requested for the detained suspects, uncle Salim Güran, mother Yüksel Güran, brother Enes Güran, and Nevzat Bahtiyar, on charges of "intentional killing of a child in complicity." The indictment prepared by the Diyarbakır Chief Public Prosecutor's Office was submitted to the Diyarbakır 8th High Criminal Court.

The indictment prepared against the 4 suspects at the end of a process followed with curiosity for weeks has caused reactions in the public. Stating that the prosecutor's office acted with the instinct to protect the family, Karabulut said, "The phrase 'could not be determined' is used regarding the reason and motive for the murder. This is an indictment acting with the instinct of hiding a crime within a crime, that is, hiding another crime within a murder."

Karabulut stated the following:

“The file with 22 suspects consists of 12 pages. We see that there has not been a sufficiently effective investigation from the very first stage of the investigation phase. At the very least, from the beginning of the investigation, that is, from the moment Narin went missing, ambient listening, wiretapping, and communication detection records should have absolutely been made. It is understood that this was not done or was done late. Along with this, based on the narrowed base station record, it is claimed that the family came together. This is not very possible technically; in fact, saying that the family came together based on the narrowed base station record presents the claim with a weak justification.

According to the indictment leaked to the press, aggravated life imprisonment is requested for Narin's uncle Salim, mother Yüksel, Nevzat Bahtiyar, and brother Enes under Article 82 of the Turkish Penal Code (TCK) in conjunction with Article 37. It mentions the principle of dominance over the crime within the framework of Article 37, in unity of thought and action. The indictment was prepared with this justification, but unfortunately, no concrete justification is stated in the indictment regarding the complicity of those other than Nevzat Bahtiyar, namely the mother, uncle, and brother.

Here, the prime suspect is Salim Güran, and the second prime suspect is Enes Güran. The mother appears to be in a position of watching the murder. Again, in the indictment, when the mother's statements are evaluated together with the statements of other witnesses, the mother is concerned with saving Enes. This makes one think that Enes and uncle Salim Güran committed the murder together. For the mother, there may be a unity of thought but perhaps not a unity of action. However, it is still too early to say anything. The mother's situation will become clearer with the collection of some evidence during the prosecution phase.

According to the indictment; mother Yüksel Güran and Nevzat Bahtiyar should receive aggravated life imprisonment for destroying evidence, and Enes Güran and Salim Güran for participating in the murder in unity of thought and action. There is an important issue. There is the situation of the prosecutor's office acting with the instinct to protect the family. The phrase 'could not be determined' is used regarding the reason and motive for the murder. This is an indictment acting with the instinct of hiding a crime within a crime, that is, hiding another crime within a murder, and there is a unity of thought among the family. This has not yet been determined. I hope that if there are any confessions in the statements during the prosecution phase, the reason for this murder and why it happened will emerge. At least as much as those who committed the murder, the reason for the murder is also very important.

In my opinion, Narin was murdered in order to destroy evidence and cover up a crime. Whether the reason is not revealed is directly related to whether the subject is political or not.”
