New legislative preparations in the Turkish Parliament

The disarmament process of the separatist terrorist organization PKK is being addressed by the National Solidarity, Brotherhood and Democracy Commission established in the Turkish Grand National Assembly (TBMM). Preparations for this process are being determined through a new legal regulation referred to as a "code law." The commission is focused on amendments to be made to the Anti-Terror Law and execution laws to prepare the legal framework.

PREPARATION OF THE CODE LAW AND RELATED REGULATIONS EXPECTED

The commission plans to prepare a comprehensive report to determine the targeted legal regulations regarding the PKK terrorist organization's disarmament process. The "code law" proposal is expected to be limited to the definition of an "organization that terminates its organizational existence," specifically targeting the PKK. Furthermore, it is aimed to complete the disarmament process through regulations to be made in the Anti-Terror Law and execution laws.

REPORT TO BE SUBMITTED BY NOVEMBER 15

The report prepared by the commission is aimed to be submitted to the relevant specialized commission by November 15 and brought to the TBMM General Assembly before budget negotiations begin. The report will cover regulations regarding the terrorist organization PKK and provisions concerning the disarmament process, as well as special regulations regarding the Penal Execution Law and a transition law.

ALL PARTIES TO SUBMIT THEIR VIEWS IN A REPORT

All political parties participating in the commission will submit their views and proposals in a report, and a joint report is expected to be prepared. It is stated that this report will include amendments to the Anti-Terror Law, regulations to be made in the Penal Execution Law, and provisions regarding the transition law. Following the completion of this process, the aim is for the report to be submitted to the TBMM General Assembly and for the specialized commission to begin its work before November 15.

EXPERTS CONTINUE THEIR WORK

Regarding the matter, evaluations concerning the targeted legal framework are also being conducted through existing legislation in the work carried out by the Office of the Speaker of the TBMM and the Ministry of Justice.

According to a report by Birgün, the commission is receiving support from experts to establish the legal infrastructure of the process and aims to submit this legal regulation to the TBMM General Assembly along with the 2026 budget bill.

PKK TO BE LIMITED BY "CODE LAW"

The new regulations are expected to be created in a way that only covers the PKK with the definition of an "organization that terminates its organizational existence." The status of organization members involved in the disarmament process will be addressed separately in the legal regulations. In addition to this, headings regarding amendments to the Anti-Terror Law, a new execution regulation, and regulations to be made in the transition law will also be included in the "code law."

SPECIALIZED COMMISSION TO CONTINUE ITS WORK

Along with the processes in the specialized commission and the General Assembly, the National Solidarity, Brotherhood and Democracy Commission will continue to hold meetings when necessary and monitor the process.
