Objection filed against Ahmet Özer's detention

Lawyers for Esenyurt Mayor Prof. Dr. Ahmet Özer have filed an objection to his ongoing detention as part of the "Aziz İhsan Aktaş Criminal Organization Investigation." In the application submitted to the Istanbul 10th Criminal Judgeship of Peace, it was argued that Özer's detention is unlawful.

Özer had previously been tried and released in a case known as the "City Consensus Case" on charges of "being a member of a terrorist organization." However, he was unable to be released from prison due to the arrest warrant issued in the investigation launched over corruption allegations.

Lawyers Prof. Dr. Hasan Sınar and Hüseyin Ersöz drew attention in their petition to three separate expert reports stating that Özer has no connection to the crime. Reports prepared by the Ministry of Interior's Local Administrations Controllership and two independent experts revealed that Özer bears no legal responsibility.

The petition stated that, according to Article 109/3 of the Criminal Procedure Code, the detention decision is disproportionate given that there are 12 different judicial control measures available. Furthermore, the negative effects that detention would cause, considering Özer's age and health status, were emphasized.

It was noted that if Özer is released in this case as well, he could regain his freedom. The lawyers requested that their client be released and that one of the judicial control provisions be applied.
