Passed in Parliament: New rules for residential complex dues and building inspection

Discussions continued in the TBMM General Assembly on the "Draft Law on Amendments to the Land Registry Law and Certain Laws and the Decree Law No. 375," which also includes provisions regarding residential complex dues. Six more articles of the proposal were accepted during the session chaired by Deputy Speaker of the Parliament Tekin Bingöl.

Following the handling of off-agenda speeches, one-minute evaluations by deputies, statements by group deputy chairs, and motions submitted by political parties, the General Assembly moved on to the discussion of the articles of the proposal.

NEW REGULATION ON THE EVALUATION OF REAL ESTATE

Within the scope of the accepted articles; the establishment of new companies or cooperatives, becoming a partner in existing structures, or participating in capital by local administrations, affiliated organizations, local administration unions, and companies directly or indirectly affiliated with them has been made subject to the permission of the President. All types of share acquisitions, including free transfers, will also be evaluated within this scope.

With the regulation, an ex officio registration practice is introduced for transfer transactions between real estate under the private ownership of the Treasury and real estate belonging to ministries, related, and affiliated institutions. Transactions will be carried out in line with the written request of the administration holding the ownership.

The proposal also aims to utilize unused real estate in urban transformation, social housing, and social-cultural living space projects. Accordingly, 40 percent of the revenue obtained from the evaluation of the real estate will be transferred to the administration performing the transaction, while the remaining 60 percent can be used by the relevant institution, organization, and subsidiaries.

NEW CONDITIONS FOR BUILDING INSPECTION ORGANIZATIONS

The draft law also introduces changes to the "Law on Building Inspection." While the definition of "Laboratory" is being reorganized, the terms "Concrete producer" and "Soil and foundation survey organization" are being added to the law.

According to the new regulation, at least one of the partners of soil and foundation survey organizations will be required to be a geological, geophysical, or civil engineer.

In addition, collateral will be taken from building inspection, laboratory, and soil and foundation survey organizations. Partners of building inspection organizations that are penalized with a ban on taking on new work will not be able to undertake technical duties during the penalty period. Partners of organizations whose operations are terminated will not be able to serve as partners or technical personnel in another building inspection or laboratory organization for 3 years.

Similar sanctions will also be applied to laboratory organizations. Penalized laboratory partners will not be able to take on duties in other building inspection, soil and foundation survey, or laboratory organizations for the determined period.

HEAVY FINES FOR CONCRETE PRODUCERS

The proposal also includes administrative sanctions for concrete producers. If it is determined that the test results of hardened concrete do not meet the relevant standards, an administrative fine of 500 thousand liras will be imposed by the Provincial Directorate of Environment, Urbanization and Climate Change upon the proposal of the Provincial Building Inspection Commission.

Within the scope of the monitoring system carried out by the Ministry; in cases where the mixer label or waybill is missing in the poured concrete, or if the mixer label and the QR-coded waybill do not match, an administrative fine of 250 thousand liras will be imposed on concrete producers.
