Precedent-setting decision for vehicle owners: TÜVTÜRK's credit card commission is against regulations
In the Niksar district of Tokat, a citizen who objected to the commission fee charged for a payment made by credit card during a vehicle inspection has obtained a decision from the Consumer Arbitration Committee that could serve as an example for similar applications.
Ali Kaya, a resident of Tokat, took his vehicle with license plate 60 ADL 824 for inspection at the TÜVTÜRK Niksar Branch on November 4, 2025. Kaya, who wanted to pay the inspection fee by credit card, was charged a commission fee of 65.63 TL during the payment.
Despite Kaya's objection that the practice was not legal, the amount in question was collected. Following this, Kaya took the matter to the Consumer Arbitration Committee.
REGULATORY REVIEW CONDUCTED
Evaluating the application, the Arbitration Committee conducted a review within the framework of the Law on the Protection of the Consumer No. 6502 and Article 17 of the Credit Cards Law. The review included the provision that member merchants cannot demand a commission or additional service fee from the consumer for payments made by credit card.
The committee decided that the commission charged due to credit card usage was against regulations and unanimously ruled that the 65.63 TL collected must be refunded to the consumer by TÜVTÜRK.

"I PAID UNDER DURESS, THEN FILED A COMPLAINT"
Sharing his experience, Ali Kaya said the following:
"On November 4, I took my motorcycle to the Niksar TÜVTÜRK inspection station for an inspection. During payment, I said I would pay with a credit card. They stated that a commission would be charged. Although I expressed that it should not be charged, I paid it under duress. Upon this, I took the detailed payment receipt and applied to the Consumer Arbitration Committee. The committee informed me that the fee would be refunded by court order. I spoke with the TÜVTÜRK headquarters; they said the fee would not be refunded and that I could take it to enforcement if I wanted. I did not resort to this path due to the concern that the enforcement costs would fall on me."
