Remarkable new judicial year message from MHP's Yıldız: 'Detention is not a punishment'

MHP Deputy Chairman Feti Yıldız shared a post on his X account to mark the beginning of the judicial year. In his message, "trial without detention" Yıldız drew attention to the issue, stating that detention does not mean conviction and should only be applied as a temporary measure.

In trials:
where the presumption of innocence is taken as the basis, where the defendant benefits from doubt,
where no one is forced to incriminate themselves,
in independent and impartial courts
where natural judges serve,
where hearings are conducted orally, publicly, and in accordance with equity,
where cases are concluded within a reasonable time,
where evidence is direct,
that respects human rights,
that establishes protective justice,
subject to judicial review
strengthening the rule of law,
The protection of human dignity,
the protection and development of freedom of expression,
Equal and easy access to judicial services,
the existence of concepts such as democracy, the rule of law, and human rights on the basis of equality,
the full protection of the right to a fair trial,
the strengthening of restorative and compensatory justice for vulnerable groups,
the enhancement of safeguards for the right to be tried within a reasonable time,
the observance of internationally accepted principles and rules in the exercise of rights,
ensuring the prevalence of predictable and solution-oriented justice,
maintaining the balance between sanctions and enforcement,
and the uninterrupted implementation of alternative sanctions are the duty of the state. Like all judicial measures, detention is also temporary in nature.
Detention is not a punishment; it is a temporary tool that ensures the discovery of material truth, the conduct of the criminal case, or the execution of a potential future sentence.
Because it is a very severe protective measure that restricts the right to personal liberty and security, detention must be applied under strict conditions, temporarily, and with great care and diligence, and must be resorted to accordingly.

MESSAGE FROM BAHÇELİ REGARDING THE JUDICIARY AS WELL
MHP Chairman Devlet Bahçeli had also recently made a similar call, pointing to the investigations into municipalities. Bahçeli had made the following statement:
"Turkey must rapidly rid itself of the intensifying legal cases that have spread to many areas, primarily municipalities, and ultimately, the complete manifestation of justice must be ensured. With the end of the judicial recess, the baseless debates and friction surrounding the judiciary must be definitively ended, and the ongoing investigations and prosecutions must be completed as soon as possible; this should be our priority in terms of democracy and legal security."
