Sentences handed down to family members who forced their tenant to wear women's clothing and dance

Mehmet Ö., who worked in daily jobs in the Yenişehir district, rented a room in Ozan Uyar's house in the Yıldırım district. After staying in the house for 3 days, Mehmet Ö. informed the landlord that he wanted to leave, saying, "Too many guests are coming here," and asked for his money back. Landlord Ozan Uyar, stating that he did not have cash, gave his mobile phone to his tenant to sell in exchange for the debt.

Allegedly, 10 days later, Ozan Uyar called Mehmet Ö. to his house to 'make amends' and, together with his friends S.S. and V.K., tied his hands behind his back and beat him with iron rods and sticks.

Mehmet Ö., who was also beaten by Ozan Uyar's father, Osman Uyar, who came down from the upper floor after hearing the noise, was also allegedly forced to wear women's underwear found in her bag by the landlord's wife, Mine Uyar, who came to the house a day later.

Mehmet Ö., who was forced to dance to music and whose photos were published on social media, was rescued by the wife of V.K., who came to the house after seeing the post, and was handed over to the police. Of the 5 suspects taken into custody, landlord Ozan Uyar, V.K., and S.S. were arrested, while the other 2 suspects were released.

Following the prosecutor's investigation, a lawsuit was filed against the 5 defendants at the Bursa 9th High Criminal Court for the crimes of 'Deprivation of liberty' and 'Robbery at night in a residence with a weapon and by more than one person'.

"THEY HIT ME MERCILESSLY WITH AN IRON ROD AND A LARGE STICK"

Testifying at the hearing where the detained defendants were released during the trial process, Mehmet Ö. said, "I work as a daily laborer. I agreed to use a room in Ozan's house, whom I met on the recommendation of a friend, for 4 thousand liras per month. The number of people coming and going to the house was unclear. I was uncomfortable. On the 3rd day, I said I would leave and asked for my money. He said he didn't have cash and gave me his mobile phone to sell. 10 days later, he called and said, 'I want to talk to you to make amends,' and invited me to his residence. I went. When I entered the house, he and his two friends locked the door and attacked me. They hit me mercilessly with an iron rod and a large stick. They beat me very badly. Since I knew the house, I said I needed to use the bathroom. They allowed it. I shouted from the bathroom ventilation shaft and asked for help. I couldn't make my voice heard. Upon this, they broke the door and took me out of the bathroom. They tied me up with hog-tie. They continued the torture," he said.

'THEY HURT ME'

Crying while giving his statement, Mehmet Ö. described what he went through: "On the second day I stayed at the house, Ozan's father, who lives upstairs, came to the house and slapped me twice. Then his wife came to us, made me wear women's underwear, made me dance to music, took my photos, and shared them on social media. They hurt me a lot. The wife of V.K., one of the defendants who saw the post on social media, came to the house, took me from their hands, and brought me to the police," he explained.

"HE STOLE MY PHONE, CURSED AT ME AND MY WIFE"

Ozan Uyar, who did not accept the accusations in court, stated that the complainant was not telling the truth and said, "Mehmet Ö., to whom I gave a room in my house, stole my phone. Moreover, he cursed at me and my wife. I only beat him."

At the hearing where Mine Uyar said, "When I came home, the complainant was wearing women's underwear. I have nothing to do with the incident"; while Osman Uyar and V.K. did not accept the accusations directed at them, S.S.'s lawyer Canan Kongur said that her client had nothing to do with this matter.

Lawyer Kongur defended her client by saying, "My client was definitely not present in that environment on the day and at the moment of the incident while the complainant was being beaten, forced to wear women's underwear, and photographed. I request his acquittal."

FAMILY-WIDE SENTENCE

Following the trial, which reached the decision stage, the court panel sentenced Ozan Uyar, who is detained for another crime, to a total of 6 years and 6 months, and his wife and father to 5 years each for the crimes of 'Deprivation of liberty', 'Robbery at night in a residence with a weapon and by more than one person' and 'Possession of an unlicensed weapon'.
