She did not believe her daughter who said she was sexually abused, did not file a complaint

In Gebze, 3 years ago, a 13-year-old girl named G.H.B. alleged that a painter named E.D., who had come to her grandmother's house, had sexually abused her.

The girl told her family about the situation. E.D., who was taken into custody upon the complaint, was released under judicial control after his statement.

"I WILL HARM YOUR LOVED ONES" THREAT

The final hearing of the case filed against the non-detained defendant E.D., who was tried for the crime of "sexual abuse of a child by molestation," was held at the Kocaeli 4th High Criminal Court. The non-detained defendant E.D., her mother I.E., and the lawyers of the parties attended the hearing. G.H.B., who is now 16 years old, attended the hearing via SEGBIS accompanied by a pedagogue.

Stating that she is staying at the Child Monitoring Center in Gebze, G.H.B. said, "I was living with my grandmother until the incident happened. My grandmother was my foster family. In May 2021, my grandmother called a master to paint the house. My grandmother and my brother left the house to buy paint. Also, my grandmother told me to help the master. E.D. cornered me between the wall in the room and tried to kiss me. He put his hand inside my clothes and touched my chest. Then he took off his pants and undressed. I said, 'Don't you dare do such a thing.' The defendant told me, 'Don't you dare tell anyone, or I will harm your loved ones.' When my grandmother and brother came, I couldn't say anything out of fear. The incident ended this way. A short time later, I told my family about the situation. I am filing a complaint," she said.

HER MOTHER DID NOT FILE A COMPLAINT

G.H.B.'s mother, I.M., who was heard regarding the incident, said, "I have custody of my daughter, but she is currently staying in social services due to the events that took place. My daughter has been living with my mother since the first grade. I learned about the incident from my mother. I am not complaining about the defendant due to the incident that occurred. G.H.B. told me that she did what happened with the defendant with her own consent. My daughter is someone who constantly lies. She secretly takes money from bags. My daughter also had a complaint against her father in another court. I think she is lying in this incident just as she did with her father. My daughter was also acting flirtatiously toward the man I was going to marry. I have no complaint," she said.

ACQUITTED

Upon the judge's question, "You say your daughter has been living with your mother since the first grade, how do you know she is lying?" the mother I.M. stated, "I live in Antalya, but I come to see my daughter every 3-4 months."

The defendant did not accept the accusations and requested his acquittal.

The court panel decided to acquit the defendant as no definitive result or evidence could be obtained that he committed the crime he was charged with.
