Statement on Can Atalay from the President of the Istanbul Bar Association

The reasoned decision of the Constitutional Court (AYM) regarding Gezi prisoner and TİP Hatay MP Can Atalay was published in the Official Gazette; the AYM, which ruled for a violation of rights and his release, also ordered 50,000 TL in non-pecuniary damages.

Istanbul Bar Association President Lawyer Filiz Saraç shared a post titled ''The Istanbul 13th High Criminal Court must implement the AYM ruling immediately''.

Saraç's statement is as follows:

''The Istanbul 13th High Criminal Court must implement the AYM ruling immediately!

The Constitutional Court (AYM), with its decision published in the Official Gazette on 27.10.2023, ruled that the Right to be Elected and Engage in Political Activity and the Right to Personal Liberty and Security of Hatay MP and our Bar member Lawyer Şerafettin Can Atalay have been violated. According to Article 153 of the Constitution, "Constitutional Court decisions are published immediately in the Official Gazette and bind the legislative, executive, and judicial organs, administrative authorities, and real and legal persons." Despite the AYM's violation ruling, what is the Istanbul 13th High Criminal Court panel still deliberating!''
