Turkey had appealed the ECHR ruling: Statement from Selahattin Demirtaş's lawyer
Following Turkey's appeal against the second release ruling issued by the ECHR regarding Demirtaş, Selahattin Demirtaş's lawyer Mahsuni Karaman has broken his silence. Karaman emphasized that the government's appeal does not eliminate the obligation to comply with the ruling.
Turkey's response to the second release ruling issued by the 2nd Section of the European Court of Human Rights (ECHR) regarding former HDP Co-Chair Selahattin Demirtaş was not delayed. Ankara has requested that the ruling in question be re-evaluated by the ECHR Grand Chamber.
This development has caused widespread repercussions in both political and legal circles. The DEM Party, in particular, reacted sharply to Turkey's appeal. The party's statement included the following expressions:
“The ECHR says ‘he must be released immediately’; the Ministry of Justice, however, insists on continuing the lawlessness. The ruling is extremely clear: dear Selahattin Demirtaş must be released. Insisting on not recognizing international legal rulings carries no meaning other than admitting to lawlessness.”
“THE APPEAL DOES NOT REMOVE THE OBLIGATION TO COMPLY WITH THE RULING”
Following the DEM Party's statement, Demirtaş's lawyer Mahsuni Karaman also broke his silence. In a post on his social media account, Karaman stated that Turkey's appeal against the ECHR ruling does not eliminate the legal obligation.
Karaman included the following statements in his post:
“The fact that the government has appealed the ECHR ruling does not remove the obligation to comply with the ruling.
Our application for the release of Mr. Demirtaş and his colleagues is still under review by the Appellate Chamber.
A return to the rule of law is always possible. Why not right now...”
