Up to 13 years and 6 months in prison sought for CHP bus driver

In the indictment prepared by the Ankara Chief Public Prosecutor's Office, police officers Mehmet Ö, Okan A, Okan Y, Sare Y, and Yasemin K, who serve at the Traffic Inspection Branch Directorate, are listed as complainants, while the bus driver Gökhan Gülyurt is named as the suspect.

According to the information in the indictment, the official vehicle with license plate 06 CHP 66, driven by the suspect Gülyurt and carrying CHP deputies and deputy chairmen, was traveling from Hipodrom Street toward Talatpaşa Street on April 23 when complainant police officers Sare Y. and Okan A. attempted to stop the vehicle by giving a 'stop' warning to learn which direction the bus was heading.

After driving the vehicle toward Sare Y. and Okan A, Gülyurt turned from Talatpaşa Boulevard onto Altınsoy Street and proceeded toward the Ankara Courthouse.

Despite complainant police officer Mehmet Ö, who was on duty in front of the courthouse, raising his hand and persistently signaling the suspect to "stop," the vehicle did not stop. Mehmet Ö jumped to the side of the road to avoid being hit by the bus.

BUS CONSIDERED A WEAPON

According to his statement in the indictment, Gülyurt stated that they wanted to go to the old Parliament building in Ulus with the official bus allocated to the party leader, which was carrying 17 deputies and 2 deputy chairmen.

Stating that they used the road in front of the courthouse to keep up with the program schedule, Gülyurt said, "The police wanted to stop the bus. However, I could not stop because my braking distance was long due to the weight of the bus. To make it to the program, the deputies and our party deputy chairmen asked me to continue on the road."

The indictment stated that Gülyurt's act of driving the "bus, which is considered a weapon," toward the complainants was evaluated as the use of force, and that the crime of resisting to obstruct duty was committed with all its elements. The following statements were also included:

"It has been understood that after driving the bus toward complainants Sare Y. and Okan A. on Hipodrom Street, the suspect drove the bus under his control toward complainant Mehmet Ö. on Altınsoy Street, and subsequently toward complainants Okan Y. and Yasemin K. on Atatürk Boulevard.

It has been determined that the complainants Sare Y. and Okan A., complainant Mehmet Ö., and complainants Okan Y. and Yasemin K. were in different locations without spatial unity, and that they issued separate 'stop' warnings to the suspect. Despite seeing these 'stop' warnings, the suspect committed the alleged crime three times by driving the bus, which is considered a weapon, toward the complainants within the scope of a decision to commit a new crime each time. It has been concluded that, since the suspect committed the crimes against complainants Sare Y. and Okan A., and against complainants Okan Y. and Yasemin K. with a single act, the provisions for chain crimes should also be applied to the suspect."

The indictment requests that Gülyurt be sentenced to up to 13 years and 6 months in prison for the crime of 'resisting to prevent duty' in a chain of events.
