Urban Transformation Presidency established

According to the decision published in the Official Gazette with the signature of AKP Chairman and President Erdoğan, the Urban Transformation Presidency has been established. 2,665 staff positions have been allocated to the Urban Transformation Presidency, which was established under the Ministry of Environment, Urbanization and Climate Change.

The decision included the following statements:

“PRESIDENTIAL DECREE ON AMENDMENTS TO CERTAIN PRESIDENTIAL DECREES

Decree Number: 153

ARTICLE 1- Clause (ı) of the first paragraph of Article 97 of the Presidential Decree No. 1 on the Presidential Organization has been repealed.

ARTICLE 2- Clause (f) of the first paragraph of Article 99 of the Presidential Decree No. 1 has been repealed.

ARTICLE 3- The following clauses have been added after clause (d) of the first paragraph of Article 100 of the Presidential Decree No. 1, and the subsequent clauses have been renumbered accordingly.

e) To determine the procedures and principles regarding general planning, programming, feasibility, project design, operation, financing needs, and investment priorities related to the infrastructure systems of local administrations; the planning, project design, and construction of technical infrastructure facilities in accordance with spatial strategy plans, environmental plans, and zoning plans; and all kinds of surveys, projects, building permits, and occupancy permits related to these matters,

f) To ensure cooperation and coordination among local administrations regarding the establishment of technical infrastructure facilities and infrastructure unions, to provide guidance, and to maintain an inventory of technical infrastructure facilities,

ARTICLE 4- The following clause has been added after clause (d) of the first paragraph of Article 105 of the Presidential Decree No. 1, and the subsequent clause has been renumbered accordingly.

e) To carry out or have carried out the projects for all kinds of infrastructure, multi-level intersections, and bridge structures related to the applications within the scope of clause (ğ) of the first paragraph of Article 97,

ARTICLE 5- Article 106 of the Presidential Decree No. 1 has been repealed.

ARTICLE 6- The following Chapter has been added after the Fifty-Fifth Chapter of the Presidential Decree No. 4 on the Organization of Institutions and Organizations Affiliated, Related, and Associated with Ministries and Other Institutions and Organizations, and the subsequent chapter numbers have been renumbered accordingly.

FIFTY-SIXTH CHAPTER

Urban Transformation Presidency

Purpose

ARTICLE 792/I- (1) The purpose of this Chapter is to determine the organization, duties, powers, and responsibilities of the Urban Transformation Presidency, which is established to carry out urban transformation applications in areas under disaster risk and on plots and lands containing risky structures outside these areas.

Definitions

ARTICLE 792/J- (1) In this Chapter;

a) Minister: Refers to the Minister of Environment, Urbanization and Climate Change,

b) Ministry: Refers to the Ministry of Environment, Urbanization and Climate Change,

c) President: Refers to the President of Urban Transformation,

ç) Presidency: Refers to the Urban Transformation Presidency.

Establishment

ARTICLE 792/K- (1) The Urban Transformation Presidency, which has a public legal personality, a special budget, is affiliated with the Ministry, and is headquartered in Ankara, has been established to fulfill the duties and exercise the powers granted by the Law No. 6306 on the Transformation of Areas Under Disaster Risk dated 16/5/2012, other relevant legislation, and this Chapter.

Organization

ARTICLE 792/L- (1) The Presidency consists of central and provincial organizations.

Duties and powers of the Presidency

ARTICLE 792/M- (1) The duties and powers of the Presidency are as follows:

a) To perform the duties and exercise the powers granted by Law No. 6306.

b) To prepare legislation regarding the transformation of structures and areas under disaster risk.

c) To carry out the necessary preparatory procedures regarding the declaration of urban transformation and development areas within the scope of Article 73 of the Municipal Law No. 5393 dated 3/7/2005, and the declaration of renewal areas within the scope of the Law No. 5366 on the Renewal, Protection, and Use of Deteriorated Historical and Cultural Immovable Assets dated 16/6/2005.

ç) To perform other duties assigned by the Minister.

President

ARTICLE 792/N- (1) The President is the highest-ranking official of the Presidency.

(2) The President is responsible to the Minister for the execution of the services specified in this Chapter.

Vice Presidents

ARTICLE 792/O- (1) Two Vice Presidents may be appointed to assist the President in carrying out the duties of the Presidency, to perform the duties assigned by the President, and to act as deputy to the President when necessary.

Service units

ARTICLE 792/Ö- (1) The central organization of the Presidency consists of the following service units:

a) General Directorate of Urban Transformation.

b) General Directorate of Marmara Urban Transformation.

c) General Directorate of Immovable and Resource Development.

ç) Department of Risky Structures.

d) Department of Zoning Planning.

e) Department of Construction and Projects.

f) Department of Monitoring and Evaluation.

g) Department of Strategy and Finance.

ğ) Department of Personnel and Training.

h) Department of Support Services.

ı) Legal Consultancy.

i) Press and Public Relations Consultancy.

(2) The duties and powers of the service units of the Presidency are regulated by a regulation issued by the Presidency in accordance with the field of activity specified in this Chapter.

Provincial organization

ARTICLE 792/P- (1) The provincial organization of the Presidency consists of urban transformation directorates established in each province, directly affiliated with the center.

(2) The working procedures and principles of the urban transformation directorates are regulated by a regulation issued by the Presidency.

Employment of experts

ARTICLE 792/R- (1) Urban Transformation Experts and Assistant Urban Transformation Experts, who have the authority to conduct research, analysis, inspection, audit, examination, and investigation, may be employed in the central organization of the Presidency in accordance with the additional Article 41 of the Civil Servants Law No. 657 dated 14/7/1965.

Establishment of companies

ARTICLE 792/S- (1) The Presidency may establish companies or become a partner in established companies with a Presidential decision.

Coordination and cooperation

ARTICLE 792/Ş- (1) The Presidency is authorized to ensure cooperation and coordination with public institutions and organizations, universities, local administrations, non-governmental organizations, the private sector, and international organizations on matters related to its duties.

(2) Upon the request of the Presidency, public institutions and organizations shall share the digital and non-digital data and inventory information they produce that can be used in urban transformation with the Presidency, in accordance with the provisions of the Personal Data Protection Law No. 6698 dated 24/3/2016.

References

ARTICLE 792/T- (1) References made to the Ministry in the legislation regarding the duties assigned to the Presidency within the scope of this Presidential Decree shall be deemed to have been made to the Presidency.

Transitional provisions

PROVISIONAL ARTICLE 1- (1) As of the effective date of this article;

a) The Infrastructure and Urban Transformation Directorates established in the provinces of Bursa, Istanbul, and Izmir as the provincial organization of the Ministry directly affiliated with the center have been closed.

b) All kinds of movables, vehicles, tools, equipment, materials, and fixtures used by the Ministry's abolished General Directorate of Infrastructure and Urban Transformation Services and the abolished Infrastructure and Urban Transformation Directorates in the provinces of Istanbul and Izmir; all kinds of records, documents, software applications, databases, and service servers in written and electronic media belonging to this General Directorate and directorates; and debts, receivables, rights, and obligations arising from the services carried out by this General Directorate and directorates shall be deemed transferred to the Presidency.

c) The duties of those holding the positions of General Manager, Deputy General Manager, and Department Head in the Ministry's abolished General Directorate of Infrastructure and Urban Transformation Services shall terminate without the need for any further action.

ç) The provisions of the additional Article 33 of the Decree-Law No. 375 shall apply to the appointment of those in the Ministry's staff and positions who were employed in the abolished General Directorate of Infrastructure and Urban Transformation Services, the infrastructure and urban transformation units of the Provincial Directorates of Environment, Urbanization and Climate Change, and the abolished Infrastructure and Urban Transformation Directorates in the provinces of Istanbul and Izmir, to the staff and positions of the Presidency.

(2) Services that must be carried out by the Presidency and payments that must be made within the scope of Law No. 6306 shall continue to be performed by the relevant central and provincial units of the Ministry until the relevant units are established and become operational within the Presidency.

(3) The Minister is authorized to resolve any hesitations that may arise, solve problems, and direct the implementation regarding the application of this article.

ARTICLE 7- The staff and positions included in the attached list (1) have been canceled and removed from the relevant tables attached to the Presidential Decree No. 2 on General Staff and Procedure under the Ministry of Environment, Urbanization and Climate Change section, and the staff included in the attached list (2) have been created and added to the table (I) attached to the Presidential Decree No. 2 as the Urban Transformation Presidency section.

ARTICLE 8- The lines “PRESIDENT OF URBAN TRANSFORMATION” and “VICE PRESIDENTS OF URBAN TRANSFORMATION” have been added to the table (I) attached to the Presidential Decree No. 3 on the Procedures for Appointment to Senior Public Executives and Public Institutions and Organizations.

ARTICLE 9- This Presidential Decree enters into force on the date of its publication.

ARTICLE 10- The President executes the provisions of this Presidential Decree”

MINISTER ÖZHASEKİ HAD ANNOUNCED

Minister of Environment, Urbanization and Climate Change Mehmet Özhaseki, in a statement he made the day before, stated that they wanted to establish an Urban Transformation Presidency and said, “There will be 3 general directorates under the Presidency. The first will only follow Istanbul, the second will follow Turkey, and the third general directorate will create resources.”
