Kayseri'deki a high school, four students had burned a photograph of Atatürk and filmed the moment. The incident took place on October 26 last year in the İncesu district. While 12th-grade students A.K., A.N., H.E., and E.K. were together, one of the students, A.K., set fire to a photograph of Mustafa Kemal Atatürk. The incident was also shared on social media. Following the incident, the 4 students were detained by gendarmerie teams. After their procedures at the District Gendarmerie Command, the 4 suspects were referred to the courthouse and arrested for the crime of 'publicly insulting the memory of Atatürk'.

In the trial where 4 high school students were being tried without arrest in the İncesu district of Kayseri for allegedly burning a photograph of Gazi Mustafa Kemal Atatürk, a verdict has been reached. The court decided to acquit the students on the grounds that the legal elements of the crime of 'publicly insulting the memory of Atatürk' were not met.

THEY WERE RELEASED UNDER JUDICIAL CONTROL

The İncesu Chief Public Prosecutor's Office completed the investigation and prepared an indictment. In the indictment accepted by the İncesu Criminal Court of First Instance, punishment was requested for the 4 defendants for the crime of 'publicly insulting the memory of Atatürk'. The 4 detained defendants, who appeared before the judge for the first time in a closed session at the İncesu Criminal Court of First Instance last November, were released with judicial control measures.

The defendants and their lawyers were present at the final hearing of the case, which was held in a closed session. When asked for their statements in court, the defendants said, "We saw the photograph of Atatürk on the ground. We did not want the photograph of Atatürk to remain on the ground. That is why we burned it. We request our acquittal." The presiding judge decided to acquit the 4 high school students on the grounds that the legal elements of the crime of 'publicly insulting the memory of Atatürk' were not met.
