Istanbul Bar Association to hold press conference in front of Caglayan Courthouse
The Istanbul Bar Association will hold a press conference at the Caglayan Courthouse on January 9. Adding the note, "The Court of Cassation has once again shown that neither the Constitution, nor the laws, nor democracy exist," the Bar Association invited the public to the press conference.
The Istanbul Bar Association, in a statement on its official website, reacted to the decision made by the Court of Cassation regarding Can Atalay and issued a call for the press conference they will hold in front of the Caglayan Courthouse.
INVITATION TO CAGLAYAN COURTHOUSE
The Bar Association stated, "In the face of these latest developments, we, as the Bar Presidents present here, invite all lawyers and members of the press to the press conference we will hold in front of the Istanbul (Caglayan) Courthouse on Tuesday, January 9, 2024, at 12:00 PM, to raise our voices and say 'Respect for the Rule of Law'."
"IT HAS TURNED INTO A LEGAL SECURITY PROBLEM FOR ALL OUR CITIZENS"
The statement from the Istanbul Bar Association is as follows:
"Dear Colleagues, Dear Members of the Press,
Despite the second violation decision issued by the Constitutional Court regarding Attorney Ş. Can ATALAY, the 3rd Criminal Chamber of the Court of Cassation has issued yet another decision that has no place in our legal system, with the expressions that 'the decision rendered by the Constitutional Court has no legal value and, in this context, there is no decision that can be implemented within the scope of Article 153/6 of the Constitution.'
Such decisions, made by judges who should decide solely according to the law and their conscience, away from any external influence, cause irreparable damage to individual rights and freedoms.
The President and Members of the 3rd Criminal Chamber of the Court of Cassation continue to commit crimes. The insistence of judges on committing crimes has once again shown us that if there is no judicial independence and impartiality, then neither the Constitution, nor the laws, nor democracy exist.
Failure to comply with the decisions of the Constitutional Court has moved the issue beyond an individual rights violation and turned it into a legal security problem for all our citizens. The quality of the rule of law enshrined in the Constitution is the guarantee for us all.
In the face of these latest developments, we, as the Bar Presidents present here, invite all lawyers and members of the press to the press conference we will hold in front of the Istanbul (Caglayan) Courthouse on Tuesday, January 9, 2024, at 12:00 PM, to raise our voices and say 'Respect for the Rule of Law'."
