While the lawsuit regarding the thousands of truckloads of sand stolen from Patara continues, the confiscated sand continues to be sold in violation of the law. Emphasizing that this is not the only irregularity in the region, Tarım-Orman İş Union President Şükrü Durmuş announced that state-owned forest lands have been illegally opened for zoning.

Durmuş stated, "Ferit Çakar, the Lycia Forest Management Chief located within the borders of the Finike Forest Management Directorate under the Antalya Regional Directorate, was exiled because he objected to the cadastre works. Due to the irregular cadastre, illegal construction in that region is continuing rapidly."

Stating that Turkish forestry has experienced its greatest destruction in the last 21 years, Durmuş noted the following: "The Forest Law has been changed 40 times. Forest production has been increased 10-15 times outside of the plan and has been handed over to capital in the interest of multinational companies. Personnel policies were implemented based on cronyism. It will take centuries for this destroyed area to return to being a forest."

Tarım Orman-İş General President Şükrü Durmuş had previously stated that 17 illegal villas were built by AKP Demre District President Bayram Arıcı and his relatives in the Beymelek-Köşkerler locality within the borders of the Antalya Demre Forest Management Chiefdom. Stating that a demolition order had been issued by the court for these villas, Durmuş had indicated that the decision was not being implemented.

17 PARCELS SAVED

Finally, while the sand theft case in Patara is ongoing, Tarım Orman-İş President Şükrü Durmuş filed a new lawsuit for the areas alleged to have been illegally opened for zoning. Upon this, following an inspection by the Ministry of Agriculture and Forestry, it was revealed as a result of the audits that the 17 parcels were forest land and that opening them for zoning was illegal.

HOW DOES FOREST LAW NO. 6831 WORK?

Naturally grown and labor-grown tree and shrub communities are considered forests along with their land.

Areas removed from forest boundaries are registered in the name of the Treasury if they are state forests, in the name of public institutions with legal personality if they are forests belonging to these institutions, and in the name of their owners if they are private forests.

Since forests are areas under the rule and disposal of the state in accordance with Article 169 of the Constitution of the Republic of Turkey, these areas should not be subject to private ownership.

HOW ARE AREAS INCLUDED IN 2B FOREST CADASTRE SAVED?

Correction procedures can be performed on maps determined to be erroneous. The process of removing forest areas from forest boundaries to be used for other purposes is simply called the "2/B" application. The legal basis for "2/B" is Articles 169 and 170 of the Constitution and Article 2/B of Law No. 6831.

As a result of the inspection carried out by the Ministry of Agriculture and Forestry in accordance with Law No. 6831, following the opening of lands considered illegal forests in Antalya to zoning and rent through irregular cadastre with 2B, 17 parcels of forest land were removed from the zoning plan in accordance with the regulation.
