Preparations for a lawsuit against TurkStat, which has been the target of criticism over the inflation data it releases, have begun. Retirees and salaried employees may seek compensation for the loss of rights they have experienced.
A new lawsuit preparation has begun against the Turkish Statistical Institute (TurkStat), which has been criticized for the inflation data it releases, leading to lower pay raises for millions of retirees and employees.
According to a report by Erdoğan Süzer from Sözcü, Ankara Bar Association lawyer Ali Erdem Gündoğan stated that anyone whose salary or pension is adjusted based on TurkStat inflation can individually file a lawsuit against TurkStat to recover losses from past periods, noting that the legal path for this is open.
Gündoğan explained the official application process to TurkStat and the subsequent court process as follows:
'PAY RAISES FOR MILLIONS OF EMPLOYEES COULD BE UPDATED'
“Retirees or active employees, because they have a legal interest, will first officially apply to TurkStat to request that the inflation data, which does not reflect reality, be corrected and that accurate data be published. If TurkStat does not respond to this application within 30 days, the citizen's request is considered implicitly rejected. Based on Article 10 of the Administrative Procedure Law, the same citizen can then file a lawsuit in administrative court within 60 days, requesting that the court determine the true data through expert witnesses to prove that TurkStat's data does not reflect reality. When a lawsuit is filed, TurkStat is obligated to provide all data and information requested of it to the court. During the trial process, the court forms a committee of expert statisticians and requests the calculation of the actual data. If the expert committee concludes that the data does not align with market realities, the court orders TurkStat to correct the data and reflect the true figures. This creates the possibility of remedying retroactive losses of rights.”
Lawyer Gündoğan stated that if TurkStat updates its data following a court order, the pay raises for millions of employees and retirees would also be updated.
