Heartbreaking words from a father whose child was murdered

The incident occurred on March 29 at around 23:00 in a park on Ahmet Lütfü Arat Street in the Derbent neighborhood of the Kartepe district. According to the information obtained, an argument broke out between Hikmet Ş. and Hasan Hüseyin Osmanoğlu (34) and his older brother Halil İbrahim Osmanoğlu. In the fight that ensued as the argument escalated, H.Ş. pulled a gun from his waistband and fired 3 shots. Hasan Hüseyin Osmanoğlu, the target of the bullets, was shot in the chest and seriously injured. While Hasan Hüseyin lay on the ground covered in blood, Hikmet Ş. fled the scene. Hasan Hüseyin Osmanoğlu, who was taken to the hospital, could not be saved despite all interventions and lost his life.

Police teams, who launched an investigation into the incident, apprehended H.Ş., who committed the act, along with Adem A. and Ertuğrul Ç. The 3 suspects were referred to the courthouse after their procedures were completed at the Public Security Branch Office's Murder Bureau. While A.A. and E.Ç. were released by the court with judicial control conditions, Hikmet Ş. was arrested and sent to prison. The first hearing regarding the incident began at the Kocaeli 4th High Criminal Court. The hearing was attended by Hikmet Ş., who is being tried under arrest for "premeditated murder under unjust provocation," and Adem A. and Ertuğrul Ç., who are being tried without arrest for "aiding and abetting a criminal," as well as the parties' lawyers, families, and witnesses. Detained defendant Hikmet Ş. said, "The day of the incident was the last day of Ramadan. I broke my fast and left the house. I sat in the gazebo where I always go and ate sunflower seeds. After a while, 2 people arrived. One sat to my right and one to my left; they cornered me. It was the victim and his brother. His brother held my shoulder. My gun was in my waistband. I said, 'Who are you?' The victim, Hüseyin, whose face and name I only knew from social media, said to me, 'Are you following me?' I said, 'No. Why would I follow you?' Hüseyin said to me, 'I have put men on your tail.'" Continuing his statement, Hikmet Ş. said, "I said to Hüseyin, 'Why are you calling my wife, are you a man, calling a married woman?' His brother also agreed with me. Hüseyin said to me, 'I will call her, what is it to you? I took your wife out for coffee, who are you?' We started arguing. I said, 'Are you a man, are you a decent person?' As the argument heated up, I pulled my gun to scare them. I pointed the gun at the ground, towards his feet, but his brother grabbed the pistol and it went off 3 times. Upon this, Hüseyin fell to the ground. I started struggling with his brother and we fell to the ground. His brother later ran away. Hüseyin's last words to me were 'You are right.' I was going to call an ambulance, but when a large group came to where we were, I ran away. I jumped onto the train tracks, where I dropped my phone and car keys. I coincidentally saw Ertuğrul's father on the road. I called Ertuğrul from his phone. They left me on a mountain with Adem. They had no knowledge of the incident."

When asked where he knew the victim from, defendant Hikmet Ş. stated, "I saw that my wife was constantly in contact with a number, I asked who the number belonged to, and upon this, she went to a women's shelter. I learned from a phone shop that the number belonged to the victim, Hüseyin. I only saw his face on his social media account and never communicated with him. These events happened 15 days after I saw my wife's phone call. Before the death incident, several people cut me off with a vehicle and I fled. I don't know who they were, but because of that incident, I started carrying a gun with me out of fear. I even changed my vehicle's license plate. When Hüseyin said 'I put men on your tail' on the day of the incident, I understood the situation. I had already pulled out the gun to scare them because I thought they were going to beat me up on the day of the incident." Defendant Ertuğrul Ç., who is being tried without arrest and stated that he had no connection to the incident, said, "Someone called from my father's number and said 'Come urgently.' Since my father had an angiogram, I went home immediately out of fear. When I got home, Hikmet brother was at the door. We also took Adem and left Hikmet where he said. After a while, law enforcement came to our house. I took the police to the place where I dropped off Hikmet, but he wasn't there. I had no knowledge of the incident, I learned about the situation at the police station." Adem A. also said he had no knowledge of the incident. The victim's father, Ali Rıza Osmanoğlu, who was heard as a complainant, said, "My son Hüseyin works in the place we operate, serving pita and lahmacun. When I was in Trabzon, he called me one day and said he was being threatened by a woman. She was saying, 'You will take me.' When he took orders to the woman's house, she would write 'I love you' on the change she gave. She would open the door inappropriately. She would hold his hand while giving the money. My son said the woman wouldn't let go. I came to Kocaeli when he said he was being threatened with death by the defendant Hikmet. The defendant told my son, 'Leave these parts.' My son said, 'Why should I leave here, you take care of your wife.' When he went to deliver, the defendant was constantly following my son. My son told me all of this. They went to the scene to talk, but the defendant came with a gun. My son was going to come to Trabzon for the holiday; he came, but in a coffin." Mother Hamide Osmanoğlu also stated that her son Hüseyin had nothing to do with such matters and filed a complaint.

The victim's wife, Zübeyde Osmanoğlu, said, "A person named Fatma sent me a message on Messenger on March 11. Fatma sent a message saying, 'He wasn't mine, he won't be yours either. Your husband played with me, he ruined my home. I will ruin yours too.' When I told my husband about the situation, he said, 'The woman has become a nuisance, I can't get rid of her. I will handle it, you don't get involved.' The defendant's daughter also sent me a message saying, 'We have been trying to get my father to give up on this for 2 months.' After the incident, the defendant's family constantly called and messaged me. They said, 'We will look after your children until they are 18, if you want a house we will give it, just don't file a complaint against our son,' but I am filing a complaint to the end." The victim's brother, Halil İbrahim Osmanoğlu, who was heard as a witness, said, "We met with my brother on the 10th of Ramadan. He said Hikmet was following him. He said the defendant's wife was constantly ordering from the lahmacun shop they operate, and she was writing things like 'I love you, I want you' on the money she paid. It turned into an obsessive situation. Hüseyin said there was nothing between them in terms of a relationship. On the eve of the holiday, my brother said Hikmet was around the bakery again. I went to the bakery. We went to talk to Hikmet, who was in the gazebo with Hüseyin. We greeted him, asked for permission to sit, and sat down. I said I was Hüseyin's brother and that we came to talk about and resolve the issues. Hüseyin explained the messages sent by Hikmet's wife. When Hikmet wanted to confront him, Hüseyin accepted. Hikmet started saying, 'Are you a man?' He repeated it 3 or 4 times. He said to Hüseyin, 'Get away from me, go across.' Hüseyin stood in front of both of us. Hikmet said 'Are you a man?' again and started firing; I jumped on him, but the bullet had already hit Hüseyin. He fired 3 shots. The bullet was at the tip of the barrel, the pistol was already ready. Then we collapsed to the ground together. Later, I went and got a knife from the shop to stab the vehicle's tire, but when I came back, Hikmet was gone. Hüseyin's phone card is registered in my name." The victim's colleague, Gökhan T., who was heard as a witness, said, "I know Hüseyin was being followed. Every evening at the same time, a vehicle was following us to the bakery. The person named Fatma was writing things like 'I want you, I love you' on the tips she gave. Hüseyin had shown me these writings on the money. Hüseyin also showed me the messages coming from social media, 'I want you.' The message had arrived. Hüseyin was saying he didn't want it, he was blocking her on social media."

Intervening, defendant Hikmet Ş. denied what was said, stating that his wife was illiterate. Hikmet Ş. said, "I was cracking sunflower seeds, they came and cornered me. If the victim's brother hadn't grabbed my wrist, the incident wouldn't have happened. I had no intention of killing. I have 3 children, I wouldn't want to leave anyone's child an orphan."

The defendant's lawyer stated that on the day of the incident, defendant Hikmet called Fatma from Ertuğrul's father's phone and said, "You can be at ease now, I shot the man."

The court panel decided to continue the detention of defendant Hikmet Ş. and to summon Fatma Ş. to testify, and adjourned the hearing.
