Criminal complaint filed against Akın Gürlek

Istanbul Chief Public Prosecutor Akın Gürlek is facing accusations of "misconduct in office" due to his statements regarding the investigation into the Istanbul Metropolitan Municipality (İBB). Criminal complaint filed against Akın Gürlek

Former YARSAV President Ömer Faruk Eminağaoğlu has filed a criminal complaint with the Council of Judges and Prosecutors (HSK), alleging that Istanbul Chief Public Prosecutor Akın Gürlek violated the confidentiality of an ongoing investigation into the Istanbul Metropolitan Municipality. Eminağaoğlu claimed that Gürlek violated confidentiality by providing information about ongoing investigations in an interview he gave to the Yeni Şafak newspaper on November 24, 2025.

In his petition, Eminağaoğlu stated, "The indictment prepared by the Istanbul Chief Public Prosecutor's Office was accepted by the Istanbul 40th High Criminal Court on November 25, 2025. However, investigations into matters such as İSKİ A.Ş. and İGDAŞ A.Ş. are still ongoing, and confidentiality orders remain in effect. Chief Prosecutor Gürlek making statements to the press during this process constitutes the crime of violating confidentiality under Law No. 5237."

Eminağaoğlu further expressed his demands, stating, "The Chief Prosecutor may only make statements to the press on administrative matters or at professional meetings. Providing information to the press about investigations he is conducting exceeds the rules of his office and constitutes the crime of misconduct in office under Article 257 of Law No. 5237. Therefore, a penalty of dismissal from the profession should be imposed."
