Lawyers for imprisoned TİP MP Can Atalay have applied to the Istanbul 13th High Criminal Court for his release and a stay of proceedings in his retrial, following the short-form decision issued by the Constitutional Court (AYM) General Assembly in the second application regarding the failure to comply with the violation ruling, which found violations of the rights to "be elected and engage in political activity," "personal liberty and security," and "the right to individual application."

The petition, which requests Can Atalay's release based on the short-form decision without holding a hearing, demands the implementation of the Constitutional Court's short-form decision dated December 21.

The lawyers, who requested the initiation of the retrial process, also demanded the suspension of the execution of the sentence and Atalay's release from prison.

The petition, which also included precedents regarding the case file, emphasized that delaying the implementation of the short-form decision constitutes a crime.

4 DEMANDS

The following 4 demands were included in the petition submitted to the court by lawyers Fikret İlkiz, Deniz Özen, and Akçay Taşçı:

"1. To initiate his retrial,

2. To suspend the execution of the conviction,

3. To ensure his release from the penal institution,

4. We request that a stay of proceedings decision be issued in the retrial to be conducted."

WHAT HAPPENED?

The Constitutional Court had once again issued a rights violation ruling for TİP Hatay MP Can Atalay, who is being held in prison. The short-form decision stated that it was decided to send the ruling to the Istanbul 13th High Criminal Court to initiate Atalay's retrial, suspend the execution of the conviction, ensure his release from the penal institution, and issue a stay of proceedings in the retrial to be conducted.
