Former Judges' Union President and retired judge Mustafa Karadağ:

The CHP Istanbul Provincial Congress was annulled by a court decision, and Gürsel Tekin, one of the party's former executives, was appointed as a trustee.


While legal and political debates regarding the decision continue, former Judges' Union President Mustafa Karadağ described the decision as "null and void" and emphasized that it should absolutely not be discussed within a legal context.

"THE COURT DECISION IS POLITICAL, THE RIGHT TO RESIST ARISES"

Former Judges' Union President and retired judge Mustafa Karadağ, in a statement to sol.org.tr, evaluated this court decision as more political than legal.

According to Karadağ, only the Election Board can intervene in the decisions of a political party, and a trustee cannot be appointed to a party by a court decision.

Karadağ stated that this decision shows the court has directly entered the service of the ruling power, and said the following:

 The decision is, in legal terms, "null and void" and must not be recognized. Any discussion held over the law will only grant legitimacy to this decision. If the judiciary makes a decision that is contrary to the law and influences politics, the "right to resist" of the public and political parties arises. This is now a political issue, and its solution must also be political.

Emphasizing that the decision is a direct attack on the main opposition party, Karadağ used the expression, "The Turkish judiciary has now overstepped its bounds."

Karadağ commented on the appointment of Gürsel Tekin, who had previously resigned from the party and is known to be in opposition to the party leadership, as a trustee by saying, "It is literally a 'slap in the face'."

He stated that this situation clearly shows that the judiciary has become a tool of daily politics. Warning that after these events, it could be expected that the judiciary might take a similar decision for the CHP General Assembly, Karadağ said this shows that the AKP government possesses a fascistic will.
