Right to compensation for Turks experiencing residence permit issues in France
Turkish citizens who have been victimized in France due to the long processing times for residence permit applications can request compensation from the state to cover their material and moral damages. Payments are made if concrete damages are proven.
Serious delays in residence permit applications in France are putting many immigrants, especially the Turkish community living in the country, in a difficult position. The fact that applications are not finalized during waiting periods that last months or sometimes even years leads to applicants losing their jobs and social rights. Experts point out that legal avenues are open in such cases of delay.
Administrative courts consider the failure of prefectures to complete residence permit procedures on time as a service failure. It is possible to be awarded compensation for reasons such as loss of income due to waiting, inability to benefit from social assistance, or missing out on new job opportunities. Turkish citizens, like other immigrant groups, can benefit from this right.
To request compensation, instead of going directly to court, it is necessary to first make an official application to the relevant prefecture to have the damages covered. Most of the time, no response is received to these applications, and in this case, the "implied rejection" process legally takes effect. If the prefecture does not respond within four months, victims can officially submit their compensation claim by applying to the administrative court.
French courts prioritize material losses, especially the loss of social rights and missed job opportunities. It is known that in various cases, compensation has been awarded to individuals whose residence permits were delayed and who, as a result, could not receive housing assistance or lost their jobs because a work permit was not provided.
