Court of Cassation ruling on derogatory language in spousal communication
The Court of Cassation has ruled that certain expressions used between spouses are derogatory and demeaning, stating that such language can be considered grounds for divorce.
Pointing out that the language used in marriages should remain within the framework of respect, the Court of Cassation emphasized that derogatory and demeaning expressions between spouses play a significant role in divorce cases. Such expressions are considered specific grounds in divorce proceedings and can render the party using this language at fault.
According to the Court of Cassation's precedent-setting decisions, addressing a spouse as 'Hey' or using expressions like 'Hey, you!' is accepted as grounds for divorce. Furthermore, behaviors such as giving a spouse a nickname, mocking their past financial status or weight, or addressing them as 'son' have also been counted as grounds for divorce. In a case heard in 2009, the statement 'I am not someone who should be a married person' was also evaluated as a reason for divorce.
These decisions once again highlight the importance of a language of respect and love in marriage and reveal that communication between spouses must be handled with care.
