Ruling issued regarding individual who sent sexually explicit messages to a lawyer

A female lawyer named M.A., residing in the Akyazı district, filed a complaint on Friday, November 8, stating that an individual named M.K. had sent her threatening, insulting, and sexually explicit messages via social media.

The individual, whose statement was taken at the Akyazı District Gendarmerie Command on Saturday, November 9, was released under judicial control conditions by the Akyazı Criminal Court of Peace to which he was referred.

Expressing her grievances, M.A. stated on her social media account that sufficient measures had not been taken against the individual in question and exposed the messages he had sent her.

Regarding the matter, an arrest warrant was issued today for M.K. by the Akyazı Chief Public Prosecutor's Office. The individual, who was taken into custody by gendarmerie teams and referred to the courthouse again, was arrested and sent to prison.

"I HAVE NEVER EVEN SPOKEN TO HIM OR EXCHANGED GREETINGS"

Sharing her experience on her social media account, Lawyer M.A. stated, "I am M.A., a lawyer registered with the Sakarya Bar Association, and I live in a village in the Akyazı district of Sakarya. Last summer, an individual named M.K., who lives in the same village, sent me sexually explicit messages via Facebook and Instagram."

I have no past hostility with him, nor have I ever spoken to him or even exchanged greetings. The messages in question not only contain the acts he wanted to commit against me but also include obscene content regarding other male and female neighbors in the same neighborhood."

Initially, I did not file a complaint in order to avoid causing public unrest in the area where we live and to prevent anyone from committing a crime under this provocation. The individual's family was informed of the situation, and some calm elders were asked to take precautions, and action was taken in that direction," she said.

"HE BRANDISHED A WEAPON AT ME"

In the continuation of her post, M.A. stated, "The individual did not cease his persistent stalking, began following me physically, and brandished a weapon at me. Following these events, he shared my photo on his Facebook account the night before last with the note, 'We are leaving on Sunday, Sakarya is finished.

You are my everything, my love.' This post was seen by villagers, reported to me, and consequently, I filed a complaint with the Akyazı Chief Public Prosecutor's Office on Friday, November 8. In addition to my statement in this complaint, the message contents, which I will also share here, were submitted for the prosecutor's review.

Furthermore, witnesses regarding the matter were interviewed at the Akyazı District Gendarmerie Command on the evening of the same day. The individual was taken into custody by the Gendarmerie Command that same day and was referred to the Akyazı Chief Public Prosecutor's Office on Saturday, November 9. The individual's statements in the prosecutor's office and law enforcement records also contain admissions. In line with all evidence and statements within the file, the individual was referred to the Akyazı Chief Public Prosecutor's Office for arrest.

The individual was released under judicial control by the Akyazı Criminal Court of Peace on the afternoon of Saturday, November 9, and the only measure imposed was that he should not approach me (which is impossible, as our homes are very close to each other). All evidence for the individual's arrest is present within the scope of the file. Moreover, it is clear that in the small region where we live, such an incident would cause public outrage and constitutes a severe provocation; therefore, I am of the opinion that the decision rendered in this direction was not impartial.

Along with all of this, it is evident that this decision will cause the individual to act with a sense of impunity and become emboldened. In his social media post, the individual explicitly and publicly shared that he would 'go' with me on Sunday; this post alone is clear evidence that my life or physical safety is not secure," she stated.
