Sentence reduction for husband who pepper-sprayed and stabbed his wife because he called 112

The incident occurred last July in the Toptepe neighborhood of Samsun's Canik district. According to the information obtained, M.Y. (52), who was allegedly distressed over his son F.Y.'s gambling debts, first sprayed pepper spray into the face of his wife E.Y. (51), a mother of two, in their kitchen, and then stabbed her. E.Y., left covered in blood, was taken to Samsun Training and Research Hospital by ambulance.

M.Y. was detained and arrested by teams from the Canik District Police Department's Domestic Violence and Violence Against Women Bureau. In the case opened against him at the Samsun 5th High Criminal Court, he was sentenced to 12 years and 6 months in prison for "attempted murder of a spouse" in recent months.

However, the appellate court overturned the decision, stating that the defendant should be punished under Article 36/1 of the Turkish Penal Code (TCK) because he showed remorse after the incident, called the 112 Emergency Call Center to request help, and assisted his wife after the event.

Retried at the Samsun 5th High Criminal Court, M.Y. was this time sentenced to 5 years and 20 months in prison for intentional injury, and it was decided that his detention would continue.
