It has been claimed that the parliamentary membership of Gezi prisoner and Workers' Party of Turkey (TİP) Hatay MP Can Atalay, who has not been released despite two Constitutional Court rulings of rights violations, will be revoked.
It has been claimed that the parliamentary membership of TİP Hatay MP Can Atalay, who is in prison as part of the Gezi Park trial and has not been released despite two Constitutional Court (AYM) rulings of rights violations, will be revoked next week.
According to a report by Ayşegül Kahvecioğlu from Milliyet, AKP Deputy Speaker of Parliament Bekir Bozdağ will preside over the Grand National Assembly of Turkey (TBMM) General Assembly next week and will have the decision regarding Atalay read out.
APPEAL WITHIN 7 DAYS
Atalay will be able to apply to the Constitutional Court within 7 days from the date his membership is revoked, claiming that the decision is contrary to the constitution, the law, or the internal regulations. The Constitutional Court will then be required to reach a final decision on the annulment request within 15 days.
A RELEASE AND REINSTATEMENT DECISION WILL LIKELY BE ISSUED FOR ATALAY
Conveying the assessments of some AKP officials on the subject, Kahvecioğlu included the following statements in her report:
"After Atalay's membership is revoked, the Constitutional Court will put forward a new decision with a new procedure. It will say, 'This rights violation stems from the failure to take action in accordance with the ongoing interim court ruling,' and will likely issue a release and reinstatement decision for Atalay. Then it will send this decision to Parliament, and Parliament will be obliged to do what is necessary regarding it."
A THREE-WAY MEETING HAD BEEN HELD
On January 11, MHP Chairman Devlet Bahçeli, who has been constantly calling for the revocation of Atalay's membership, AKP Chairman and President Recep Tayyip Erdoğan, and Parliament Speaker Numan Kurtulmuş held a meeting.

MHP Chairman Devlet Bahçeli had demanded the revocation of Can Atalay's parliamentary membership during his party's group meeting held in recent weeks. Targeting Constitutional Court President Zühtü Arslan, Bahçeli had stated: "I would like to ask Mr. Zühtü, who says there is no justification for not implementing Constitutional Court decisions, do you and the other court members who think like you have the heart to explain the justification for the blood shed by our martyrs and the tears of our mothers who are crying out in agony? You are worried about a wrong court decision, we are worried about our beloved homeland. You and those like you are in the cage of PKK law, we are in pursuit of the existence and independence law of the Republic of Turkey. As you can see, we are as different as night and day. We want the decision on the convict Can Atalay to be read in the TBMM immediately."
