BREAKING NEWS... Appeal filed against İmamoğlu's detention

Lawyers for Istanbul Metropolitan Municipality (İBB) Mayor Ekrem İmamoğlu, who was arrested as part of a corruption investigation following the cancellation of his diploma, have filed an appeal. The defense stated, "There is no suspicion of flight, and the detention is unlawful."

BREAKING NEWS... Appeal filed against İmamoğlu's detention

An appeal has been filed against the detention of Ekrem İmamoğlu, who was first stripped of his diploma and subsequently arrested at the prison in Silivri as part of corruption operations.

NO SUSPICION OF FLIGHT

According to the statement made by İmamoğlu's lawyers, it was reported that the detention based on the suspicion of flight is unlawful and that there is no question of Istanbul Metropolitan Municipality Mayor Ekrem İmamoğlu attempting to flee.

The petition stated, "We request that the detention of Ekrem İmamoğlu, who was ordered to be arrested as a result of an investigation conducted from start to finish through legally prohibited methods—a fact that is evident from concrete circumstances and to which tens of millions of our people have reacted with awareness—be lifted and that he be released; and in the event that the insistence on this unlawful detention continues, we request that the file be sent to the authorized and competent Criminal Court of First Instance for appellate review."

"IT IS MORE APPROPRIATE TO CALL IT SLANDER RATHER THAN AN ACCUSATION"

The petition, which stated that one of the most fundamental requirements of a criminal investigation is that "the causality between the act defined by place, date, and time and the result constituting the crime, as well as the perpetrator who caused this result, must be clearly demonstrated based on concrete facts," continued: "Based on this requirement, in the current investigation, for example, regarding the bribery allegation, there are no findings based on concrete facts as to who gave how much money to whom, on what date, and for what purpose; regarding the allegation of bid-rigging, there are no findings regarding the date and subject of the tender, or how the rigging was created through which action; and regarding the acquisition of personal data, there are no findings as to how, on what date, for what purpose, and by whom it was carried out. The allegations are put forward in a heap, without being individualized, and in an abstract and baseless manner. In this respect, the word 'slander' is more appropriate than 'accusation' for the matters put forward."

"UNLAWFUL FROM START TO FINISH"

The following statements were used in the petition:

To state it with the expression used by those who initiated and directed the investigation, let us admit that the biggest issue among the grounds for arrest is the determination that Ekrem İmamoğlu will "flee and hide." The person mentioned is the representative of sixteen million people living in Istanbul and is the strongest candidate for the Presidency of the Republic of Turkey in the first upcoming election. This determination, which even the person making it does not believe, is proof in itself of all our claims that the investigation is not being conducted in accordance with legal norms, but rather with political motives by judges and prosecutors who have lost their independence and impartiality. It is tragic.

The petition requested that the detention of Ekrem İmamoğlu, who was ordered to be arrested as a result of an investigation conducted from start to finish through legally prohibited methods, be lifted and that he be released, and that in the event that the insistence on this unlawful detention continues, the file be sent to the authorized and competent Criminal Court of First Instance for appellate review.
